HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 v&ww.miamigov.com File Number: 12-00278 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXECUTE A TEMPORARY USE AND OCCUPANCY PERMIT PROCEDURE APPLICATION ON BEHALF OF THE CITY OF MIAMI AS THE PROPERTY OWNER, IN ORDER TO ACCOMMODATE AND PROVIDE FOR RESIDENTIAL PARKING SURROUNDING THE MIAMI MARLINS STADIUM DURING THE 2012 MAJOR LEAGUE BASEBALL SEASON HOME GAMES AND OTHER STADIUM EVENTS. WHEREAS, during the 2012 Major League Baseball season the Miami Marlins Stadium ("Stadium") will host approximately eight -one (81) home games and potentially several other events (collectively "Events"), and WHEREAS, during the construction of the Stadium Miami -Dade County re -stripped the neighboring streets surrounding the Stadium to accommodate traffic ingress and egress for the Stadium Parking Facilities. As a result, residential parking in the neighboring areas of the Stadium were impacted; and WHEREAS, there are four City of Miami ("City") owned properties located in close proximity to the Stadium, specifically 1652 NW 3rd Street, 1648 NW 3rd Street, and 1643 NW 2nd Street, 1301 NW 6TH Street, Miami, Florida (collectively the "Properties"); and WHEREAS, the Properties can accommodate residential parking in the areas surrounding the Stadium during Events at the Stadium; and WHEREAS, it would be in the best interest of the City to accommodate and provide for parking for the residential community surrounding the Stadium during Events; and WHEREAS, pursuant to Section 62-528, of the Code of the City of Miami, Florida, as amended, the City provides for temporary uses of public property; and WHEREAS, the Department of Off Street Parking of the City of Miami ("MPA") has the capability to manage these Properties to accommodate residential parking during the Events, and to do so it must fill out a temporary use and occupancy permit procedure application ("Application"); and WHEREAS, the Application requires consent of the property owner; and WHEREAS, MPA shall not have possession of the property; MPA shall only have management control of the Properties during Events; and WHEREAS, the City shall reimburse MPA for any mutually agreed upon, reasonable costs or expenses associated with the management of the Properties during Events; Cio, of Miami Page 1 of 2 File Id: 12-00278 (Version: 1) Printed On: 3/14/2012 File Number: 12-00278 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized to execute a temporary use and occupancy permit procedure application on behalf of the City as the property owner, in order to accommodate and provide for residential parking surrounding the Miami Marlins Stadium during any Events. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY vP Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
