HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 v,'ww.miamigov.com File Number: 12-00222 • Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS PRIOR YEARS' RESERVE FUNDS, IN THE TOTAL AMOUNT OF $996,820; ALLOCATING SAID FUNDS TO THE AGENCIES AS SPECIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED, TO PROVIDE HOUSING ASSISTANCE AND HOUSING RELATED SERVICES DURING FISCAL YEAR 2012-2013 TO ADDITIONAL LOW INCOME INDIVIDUALS LIVING WITH AIDS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the Housing Opportunities for Persons with AIDS ("HOPWA") Program was created under the AIDS Housing Opportunity Act and revised under the Housing and Community Development Act -of 1992; and WHEREAS, since 1994 the City of Miami ("City") has received HOPWA Program funds from the United States Department of Housing and Urban Development (" HUD") and has been responsible for the implementation of programs designed to provide housing and related services to individuals living with HIV/AIDS in the City and throughout Miami -Dade County; and WHEREAS, on January 18, 2012, HUD released the final Community Planning and Development Program Formula Allocations for Fiscal Year 2012; and WHEREAS, due to reduced fair market rents in the last two years, prior years' HOPWA funds that were allocated to different programs, retained unused balances in the total amount of $996,820, as specified in Exhibit "A", attached and incorporated; and WHEREAS, the close out of these unused balances allows the Department of Community Development to reinvest these funds into the program for Fiscal Year 2012-2013 to provide Long -Term Rental Assistance to additional HOPWA-eligible clients; and WHEREAS, the City Administration recommends the transfer in the amount of $996,820, from prior year's HOPWA close-out funds and the allocation of said funds to the agencies as specified in Exhibit "A", attached and incorporated, to provide housing assistance and housing related services to low income individuals living with AIDS; NOW; THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: -Section l..�The recitals and findings contained in the Preamble -to this Resolution are adopted by - reference and incorporated as if fully set forth in this Section. The transfer of HOPWA prior years' reserve funds, in the total amount of $996,820 and the allocation of said funds to the agencies as specified in Exhibit "A", attached and incorporated, to provide housing assistance and housing related services during Fiscal Year 2012-2013 to additional low income individuals living with AIDS, is authorized. Section 3. The City Manager is authorized{1} to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE 0. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
