Code of Federal Regulations. (CFR) 222.39 and 229 Use of
Locomotive Horns at Highway -Rail Grade Crossings; Final Rule
(Final Rule).
NOTICE OF INTENT TO CREATE NEW QUIET ZONE
In order to activate the Quiet Zone described herein pursuant to the requirements of 49 CFR 222.39 and 229, the City of
Miami submits this Notice of Quiet Zone Establishment.
HIGHWAY -RAIL CROSSINGS INCLUDED IN THE QUIET ZONES
The Quiet Zone covers the segment of the Florida East Coast Railway (FEC) from the Port of Miami to NW 71st Street
which includes a total of twenty-one existing crossing locations (Table 1). Other portions of the FEC and other rail
corridors are not a part of this program.
All crossings are located within the City of Miami, Miami -Dade County, Florida, including one pedestrian -exclusive
rail grade (273139L) crossing located between South Port Boulevard and Miamarina Parkway Boulevard. There are no
existing private highway rail grade crossings within the proposed Quiet Zone.
EFFECTIVE DATE OF THE QUIET ZONE
Locomotive horn use at the listed crossings shall cease as of April 1, 2012.
REGULATORY BASIS FOR DESIGNATION OF A QUIET ZONE
The Quiet Zone will be established under the regulatory provisions of 49 CFR 222.39(a) which require implementation
of Supplemental Safety Measures (SSM) at every public crossing in the Quiet Zone.
In order to comply with the minimum SSMs, two -quad gates have been installed at the three (3) crossings that
previously only had flashing lights. These crossings are located at NW 10th Street (272646R); NW 11th Street
(272644C); and NW 14th Street (272640A).
TIME RESTRICTION
-The routine sounding of horns would be restricted twenty-four (24) hours a day, seven (7) days a week.

A Notice of Intent to Establish a Quiet•Zone atibe iocafions included as Table 1 was sent via certified mail with return
receipt on September 21, 2011 to the following agencies:
• Florida Department of Transportation
o Florida East Coast Railway
o Federal Railroad Administration
• Miami -Dade County
o Port of Miami
o Public Works and Waste Management
o City of Miami
The Notice of Intent was mailed more than 60 days before the mailing of this Notice of Quiet Zone Establishment.
Written comments or no comment statements have been received from all agencies listed above.
