HomeMy WebLinkAboutCC Legislation (Version 2) & ExhibitCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00910ww Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING FINDINGS AND APPROVING A WAIVER OF THE WATERFRONT CHARTER REQUIREMENT AS SET FORTH IN SECTIONS 3(mm)(ii)(A) AND (B), ALLOWING A REDUCTION OF THE WATERFRONT SETBACK OF TWENTY-TWO FEET (22') BY TWELVE FEET (12'), RESULTING IN A TEN -FOOT (10') WATERFRONT SETBACK, FURTHER ALLOWING A REDUCTION OF THE REQUIRED SIDE -YARD SETBACK OF SIXTY-EIGHT FEET AND NINE INCHES (68'9") BY FORTY-EIGHT FEET NINE INCHES (48'9"), RESULTING INA TWENTY -FOOT (20') SIDE -YARD SETBACK, FOR THE CRIMSON TOWER PROJECT, LOCATED AT APPROXIMATELY 527, 535 and 623 NORTHEAST 27TH STREET, MIAMI, FLORIDA. WHEREAS, on September 30, 2011, Neisen O. Kasdin, Esquire, on behalf of Mckafka Development Group, LLC, Contract Purchaser and Biscayne Bay of Miami, LLC, Owner, submitted a request for a modification of the Waterfront Charter requirement as set forth in Sections 3(mm)(ii)(A) and (B), allowing a reduction of the required waterfront setback of twenty-two feet (22') by twelve feet (12'), resulting in a ten -foot (10') waterfront setback, further allowing a reduction of the required side yard setback of sixty-eight feet and nine inches (68'9") by forty-eight feet nine inches (48'9"), resulting in a twenty -foot (20') side yard setback, for the Crimson Tower project, to be located at approximately 527, 535 and 623 Northeast 27th Street, Miami, Florida, legally described in attached "ExhibitA"; and WHEREAS, City Commission approval is required to allow modifications to the Waterfront Charter requirements; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to approve the requested Waterfront Charter modification as set forth herein ; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby finds that the Project complies with the criteria for modification to the Waterfront Charter requirement set forth in Sections 3(mm)(ii), (A) and (B) and hereby approves a reduction of the required waterfront setback of twenty-two feet (22') by twelve feet (12'), resulting in a ten -foot (10') waterfront setback, further allowing a reduction of the required side yard setback of sixty-eight feet and nine inches (68'9") by forty-eight feet nine inches (48'9"), resulting in a twenty -foot (20') side yard setback, for the Crimson Tower project, to be located at approximately 527, 535 and 623 Northeast 27th Street, Miami, Florida, legally described in attached "ExhibitA". This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission . PACKARD LAIRD'S RESUBDIVISION, according to the Plat thereof, as recorded In Plat Book 7, page(s) 81, of the Public Records of Miami -Dade County, Florida. PARCEL II Lots 22, 23, 24, 25 and 26, In Block 3 of J. PACKARD LAIRD'S RESUBDIVISION, according to the Plat thereof, as recorded in Plat Book 7, page(s) 81, together with the submerged land lying East of a Roadway or Arley which said roadway or alley is 15 feet wide and is adjacent to and bounds Lot 1 on the North of Samuel Filer's Subdivision of Section 30, Township 53 South, Range 42 East, as per Book of Plats, Page 6 and is designated on said Plat as Public Road (all of which said submerged land is further described in that certain deed by Florence Light to William G. Lipe and Clara J. Lipe, his wife, recorded in Official Records Book 2516, page 602), of the Public Records of Miami -Dade County, Florida. PARCEL III Lots 20 and 21, Block 3 of J. PACKARD LAIRD'S RESUBDIVISION, according to the Plat thereof, as recorded in Plat Book 7, page 81 of the Public Records of Miami -Dade County, Florida, together with a 15 foot strip of land lying North of, and immediately adjacent, thereto. PARCEL IV Lots 18 and 19, Block 3, of J. PACKARD LAIRD'S RESUBDIVISION, according to the Plat thereof, as recorded in Plat Book 7, page 81, of the Public Records of Miami -Dade County, Florida.
