Zoning: Urban Core Transect Zone, T6-36A-L The project as designed requires City Commission approval pursuant to Article 3.11 a, Waterfront Standards, Miami 21 Code and City Charter Section 3 (mm) (iii) for a modification of the waterfront and side setbacks. Note: Waterfront Setback Average Depth of Lot 88 ft. Minimum required per Article 3.11, M21 Code and Charter Section 3 (mm)(iii) (A) 22 ft. Requested reduction 12 ft. Resulting Setback 10 ft. Side Setback Average Width of Lot 275 ft Minimum required per Article 3.11, M21 Code and Charter Section 3 (mm)(iii) (B) 68 ft. 9 in. Proposed East 10 ft. 2 in. Requested reduction 12 ft. 8 in. • The proposed development is contingent on the approval of a re -platting application by the Plat and Street Committee • All required Waivers and all other special permits not listed above shall require separate applications and are not part of this permit. This permit only covers those listed in the application for modification. • Signs are not part of this application. A separate permit will be required. The subject of this analysis is a modification to Article 3.11 Waterfront Standards of the Miami 21 Zoning Code and, as such a complete review of the project for compliance with the Miami 21 Zoning Code and t the City of Miami Charter, Section 3 (mm) (iii) (A) and (B). In addition, the proposed project was presented to the Internal Design Review Committee, Urban Development Review Board and Coordinated Review Committee. • The waterfront relaxations to the waterfront and side setbacks are appropriate due to the peculiar narrow characteristics of the site in both directions; north -south, and eat -west. • The granting of these setbacks would allow the project to be consistent with applicable design criteria as set forth in Article 4, Table 12 of Miami 21 Code. • The granting of these relaxations are in harmony with the general intent and purpose of the City Charter. • The project as presented provides public benefits such as direct public walkways which promotes a better urban environment along the Biscayne Bay inlet. The Planning Department hereby recommends approval of the subject application with the conditions recommended by the UDRB. Final plans shall be reviewed and approved by the Planning Department prior to the issuance of a building permit I T Y 0• F. Consider, a mesh or other materials to obscure views. • Enhance buffer along east site perimeter to buffer ground floor activities, i.e. entrance / ramp to parking garage. • Explore possible recreational opportunities for City public right of way area along the bay, between NE 27111Terrace and NE 28th Street. Suggestions: • Identify solution to avoid conflicts between pedestrians approaching the watetfront along the west -side of the property and exiting vehicles from the parking garage on to NE 27th Street • Articulate the west -side facade to avoid the blank -wall effect currently shown on plan. Regalado Pursuant to State Statutes and the Interlocal Agreements for Public School Facility Planning in Miami - Dade County, the above -referenced residential development application was reviewed for compliance with Public School Concurrency. Accordingly, attached please find the District's School Concurrency Determination. As you will note, the applicable Level of Service (LOS) standards of 100% Florida Inventory of School Housing (FISH) have been met at the three school levels and as such, capacity has been reserved for a one year period, under Master Concurrency Number MA0111110300210. The reservation term for this Site Plan application will expire on November 15, 2012. Concurrency reservation may be extended for additional one-year periods, provided 1) City of Miami confirms the application is still valid; 2) you request an extension at least 120 days prior to the expiration date, via email address concurrency@dadeschools.net; and 3) the total reservation period does not exceed six years from the original effective date of this certificate. Failure to request an extension at least 120 days prior to the expiration date will result in revocation of the reservation, and a new application must be submitted. Extensions will be granted, upon payment of the corresponding review fee and acknowledgement from the local government.
