This letter shall serve as the Applicant's initial letter of intent in support of the modification. Last year, the property was rezoned to the T-5 L Urban Center Transect by the City Commission. The owners voluntarily proffered a Declaration of Restrictive Covenants at that time, which restricted development on the property to three (3) stories. The owners' current plan of development for the property complies with the maximum height required by the Declaration of Restrictions when measured from the exterior of the building. However, the owners are requesting a modification in order to replace the maximum story limitation with a maximum height to top of roof limitation of fifty-three feet (53') in order to accommodate condominium units that provide mezzanine within the project. Because the inclusion of the mezzanines, required floor to ceiling heights which exceed fourteen (14) feet, the project technically exceeds three (3) stories under Miami 21. Any modification, amendment, or release will be in a form acceptable to the City Attorney. Section 5. Inspection and Enforcement. An enforcement action may be brought by the City by action in law or in equity against any party or person violating or attempting to violate any covenants of this Declaration, or provisions of the building and zoning regulations, either to restrain violations or to recover damages. The prevailing party in the action or suit shall be entitled to recover costs and reasonable attorney's fees. This enforcement provision shall be in addition to any other remedies available under the law. This enforcement provision shall not apply against the City of Miami. Section 6. Severability. Invalidation of any one of these covenants by judgment of Court shall not affect any of the other provisions of the Declaration, which shall remain in full effect. Section 7. Recording. This Declaration shall be filed of record among the Public Records of Miami -Dade County, Florida, at the cost of the Owners within thirty (30) days of its execution by the Owners, and acceptance by the City of Miami.
