HomeMy WebLinkAboutR-12-0052City of Miami Legislation Resolution: R-12-0052 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00016 Final Action Date: 2/9/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND M & J CONSTRUCTION COMPANY OF PINELLAS COUNTY, INC., A FLORIDA FOR PROFIT CORPORATION, FOR USE OF APPROXIMATELY 7,436 SQUARE FEET OF CITY -OWNED PROPERTY LOCATED AT 1 SOUTHWEST SOUTH RIVER DRIVE, MIAMI, FLORIDA, AS CONSTRUCTION STAGING AND STORAGE OF LIGHT CONSTRUCTION EQUIPMENT AND MATERIALS IN CONNECTION WITH THE FLAGLER STREET BRIDGE PROJECT, ON A MONTH -TO -MONTH BASIS; AND PROVIDING FOR PAYMENT OF A MONTHLY USE FEE OF $2,479, PLUS STATE OF FLORIDA USE TAX, IF APPLICABLE, AS ADJUSTED BY TEN PERCENT (10%) EVERY RENEWAL TERM; FURTHER AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO SUCH AGREEMENT AS NEEDED, WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN THE AGREEMENT. WHEREAS, the City of Miami ("City") owns the property located at 1 Southwest South River Drive, Miami, Florida ("Property"); and WHEREAS, M & J Construction Company of Pinellas County, Inc., a Florida for profit corporation ("Licensee"), a subcontractor of the State of Florida Department of Transportation ("FDOT"), has expressed an interest in using the Property of approximately 7,436 square feet, for use as construction staging and storage of light equipment and materials on a month -to -month basis for the Flagler Street Bridge Project, a bridge repair project ("Project") contracted by FDOT; and WHEREAS, the City has agreed to allow the Licensee to use the Property and both the City and Licensee now desire to enter into a Revocable License Agreement ("Agreement"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the Licensee, for use of approximately 7,436 square feet of the Property, as construction staging and storage of light equipment and materials, providing for payment of a monthly Use Fee of $2,479, plus State of Florida Use Tax, if applicable, as adjusted by ten percent (10%) every renewal term. Section 3. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
