AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114,
THE MIAMI 21 CODE, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
AMENDING ARTICLE 4, ENTITLED "STANDARDS AND TABLES" AND ARTICLE 6,
ENTITLED "SUPPLEMENTAL REGULATIONS", TO MODIFY REQUIREMENTS FOR PUBLIC
AND COMMERCIAL STORAGE FACILITIES IN T5, T6, AND DISTRICT (D) ZONES;
CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board, at its meeting on December 14,
2011, following an advertised public hearing, adopted four (4) separate motions to item no. 10
for the Miami City Commission as follows: 1) Denial of the change to the square footage
limitation, which failed by a vote of four to three (4-3) {this would have resulted in public storage
facilities having a maximum area of 55,000 square feet); 2) Approval of the proposed change for
the parking requirements, which failed by a vote of six to one (6-1) {this would have resulted in
parking for public storage facilities being calculated as one (1) parking space for every 10,000
square feet with a minimum of eight (8) parking spaces}; 3) To reinstate the spacing
requirement (not strike it), which failed by a vote of three to four (3-4) {this would have resulted
in a distance separation requirement of 2,500 feet between public storage facilities within T5 or
T6}; and 4) Denial of the change to the time of operation as stated on the legislation by a vote of
seven to zero (7-0) {recommended hours of operation shall be limited from 6:00 am to 11:00
pm}; and
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
the Miami 21 Code ("Miami 21 Code"), as the Zoning Ordinance of the City of Miami, Florida;
and
WHEREAS, the demand for public storage facilities has increased due to the additional
density in the urban core; and
WHEREAS, existing regulations prevent public storage facilities from being located
within close proximity to another facility; and
WHEREAS, it has been determined that modifications to the Miami 21 Code are
needed to reflect demand and address this use more specifically; and
WHEREAS, the City Commission, after careful consideration of this matter deems it
advisable and in the best interest of the general welfare of the City of Miami and its citizens
to amend the Miami 21 Code as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Ordinance
are adopted by reference and incorporated as if fully set forth in this Section.

6.3 COMMERCIAL USES
6.3.1 Large Scale Commercial
Except for Public Storage Facilities which must comply with the criteria set forth under Article 6,
Table 13, a A single commercial establishment occupying more than 55,000 square feet of Floor
Area in any T6-O, D1 or D2 shall be permitted subject to the following requirements:
Section 3. If any section, part of a section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 4. It is the intention of the City Commission that the provisions of this
Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami,
Florida, which provisions may be renumbered or relettered and that the word "ordinance"
may be changed to "section", "article", or other appropriate word to accomplish such
intention.
Section 5. This Ordinance shall become effective 30 days after final reading and
adoption thereof. {2}
