A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING
THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST
FOR PROPOSALS NO. 270254, THAT THE TOP -RANKED FIRM FOR GROUP 1 TO
PROVIDE ON -SITE AUCTION SERVICES IS FISHER AUCTION CO., INC., AND
THAT THE TOP -RANKED FIRM FOR GROUP 2 TO PROVIDE INTERNET
AUCTION SERVICES IS RENE' BATES AUCTIONEERS, INC., FOR THE AUCTION
OF ITEMS, INCLUDING, BUT NOT LIMITED TO SURPLUS, CONFISCATED OR
FOUND ITEMS AS STATED HEREIN; AUTHORIZING THE CITY MANAGER, AFTER
CONSULTATION WITH THE CITY ATTORNEY, TO NEGOTIATE AND EXECUTE A
PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY
THE ATTACHED FORM(S), WITH SAID FIRMS, FOR A PERIOD OF THREE (3)
YEARS, WITH THE OPTION TO RENEW FOR THREE (3) ADDITIONAL ONE (1)
YEAR PERIODS, SUBJECT TO THE TERMS AND CONDITIONS STATED IN SAID
AGREEMENT. FURTHERMORE, NOTWITHSTANDING THE LANGUAGE IN
SECTION 18-86 (C) OF THE CITY CODE, THE AFOREMENTIONED OPTIONS TO
RENEW SHALL BE EXERCISABLE AT THE OPTION OF THE CITY COMMISSION
IF IT IS IN THE BEST INTEREST OF THE CITY.
WHEREAS, Request for Proposals ("RFP") No. 270254 was issued with the intent and purpose of
obtaining the services of professional auctioneering firms that may continue to provide On -Site and
Internet Auction Services to the City of Miami and member agencies of the Southeast Florida
Governmental Purchasing Cooperative; and
WHEREAS, the items auctioned, On -Site and On -Line, range from automobiles (surplus and
confiscated/found), trucks, fire -fighting equipment and vehicles, heavy equipment, boats, work
equipment, personal and mainframe computers, office equipment, furniture, jewelry, electronics,
miscellaneous police confiscated items and found property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The recommendation of the City Manager approving the findings of the Evaluation
Committee pursuant to RFP No. 270254, that the top -ranked firm for Group 1 to provide On -Site
Auction Services is Fisher Auction Co., Inc., and that the top -ranked firm for Group 2 to provide
Internet Auction Services is Rene' Bates Auctioneers, Inc., for the auction of automobiles (surplus
and confiscated/found), trucks, fire -fighting equipment and vehicles, heavy equipment, boats, work
equipment, personal and mainframe computers, office equipment, furniture, jewelry, electronics,
miscellaneous police confiscated items and found property, is accepted.

Section 3. The City Manager is authorized {1} to negotiate and execute a Professional Services
Agreement ("Agreement"), in substantially the attached form(s), with said firms, for a period of three
(3) years, with the option to renew for three (3) additional one (1) year periods, subject to the terms
and conditions stated in said Agreement.
Section 4. Notwithstanding the language in section 18-86 (c) of the City Code, the aforementioned
options to renew shall be exercisable at the option of the City Commission if it is in the best interest of
the City.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
