HomeMy WebLinkAboutCC Legislation (Version 1) & ExhibitCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01050ww Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING FINDINGS AND APPROVING WITH CONDITIONS A REDUCTION OF THE WATERFRONT SETBACK REQUIREMENTS PURSUANT TO SECTION A3(mm)(i) OF THE CITY CODE, AND ARTICLE 3.11 WATERFRONT STANDARDS OF THE MIAMI 21 ZONING ORDINANCE, ALLOWING A REDUCTION OF THE REQUIRED FIFTY FOOT (50') WATERFRONT SETBACK BY TWENTY-ONE FEET SEVEN INCHES, (21'7") RESULTING IN A TWENTY-EIGHT FOOT FIVE -INCH (28' 5") WATERFRONT SETBACK, FURTHER ALLOWING A REDUCTION OF THE REQUIRED SIDE -YARD SETBACK OF FIFTY-FOUR FEET, (54'), BY THIRTY-THREE FEET EIGHT INCHES, (33'8"), RESULTING IN A TWENTY -FOOT FOUR -INCH (20'4") SIDE -YARD SETBACK, FOR THE MIAMI RIVER APARTMENTS PROJECT, LOCATED AT APPROXIMATELY 2601 / 2621 NORTHWEST 16TH ROAD, MIAMI, FLORIDA. WHEREAS, on October 31, 2011, Iris V. Escarra, on behalf of 21 Riverfront LLC, Owner, submitted a request for modification of the Waterfront Standards requirement pursuant to Section A3(mm)(i) of the City Code and Article 3.11 of the Miami 21 Zoning Code, allowing a reduction of the required fifty foot (50') waterfront setback by twenty-one feet seven inches (21' 7"), resulting in a twenty-eight foot five -inch (28' 5") waterfront setback, further allowing a reduction of the required side -yard setback of fifty-four feet (54') by thirty-three feet eight inches, (33' 8"), resulting in a twenty -foot four -inch (20' 4") side -yard setback, for the Miami River Apartments project, to be located at approximately 2601 / 2621 Northwest 16th Road, Miami, Florida, legally described in attached "Exhibit A"; and WHEREAS, based on Section A3(mm)(i) of the City Code and Article 3.11 of the Miami 21 Zoning Code, City Commission approval is required to allow reductions to the Waterfront Standards established therein; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to approve with conditions the requested reductions to the required Waterfront and Side setbacks as set forth herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby finds that the Project complies with the criteria for modification to the Waterfront and Side setback requirements pursuant to Section A3(mm)(i) of the City Code and Article 3.11 of the Miami 21 Zoning Code and hereby approves with conditions a City of Miami Page 1 of 2 File Id: 11-01050ww (Version: 1) Printed On: 12/6/2011 File Number: 11-01050ww reduction of the required fifty foot (50') waterfront setback by twenty-one feet seven inches (21' 7"), resulting in a twenty-eight foot five -inch (28' 5") waterfront setback, further allowing a reduction of the required side -yard setback of fifty-four feet (54') by thirty-three feet eight inches, (33' 8"), resulting in a twenty -foot four -inch (20' 4") side -yard setback, for the Miami River Apartments project, to be located at approximately 2601 / 2621 Northwest 16th Road, Miami, Florida, legally described in attached "Exhibit A. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission .
