HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01182 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/STHS), AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92(A)(1) AND (3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF PREVENTATIVE MAINTENANCE AND EXTENDED WARRANTY SERVICE FOR 911 WORKSTATIONS, FROM WRIGHT LINE, LLC., A WHOLLY OWNED SUBSIDIARY OF EATON CORPORATION, FOR THE DEPARTMENT OF POLICE, FOR A TERM OF FIVE (5) YEARS, IN AN AMOUNT NOT TO EXCEED $68,500; ALLOCATING FUNDS FROM THE DEPARTMENT OF POLICE E9-1-1 ACCOUNT CODE NO. 12000.190351.546000.0000.00000, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 04-0338, adopted May 27, 2004, the Department of Police purchased and had installed call taker/dispatch consoles, and other furniture and equipment ("Equipment"), at the Police and Fire -Rescue 911 center, including E-911 back-up site at the Fire College, from Wright Line, LLC., a wholly owned subsidiary of Eaton Corporation ("Provider"), using State of Florida Contract No. 425-001-01-1; and WHEREAS, the original purchase and installation price of $426,291.87, was inclusive of a five (5) year preventative maintenance and extended warranty service, which expired on November 2010; and WHEREAS, due to the continuous wear and tear of the mechanical parts of the Equipment, and to protect the integrity and functionality of the Equipment and the City of Miami ("City") facilities where the Equipment is located, it is crucial that the Department of Police continue receiving Preventative Maintenance and Extended Warranty Service from the Provider, the sole -source of said services; and WHEREAS, pursuant to Section 18-92(a) (1) and (3) of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that the Provider, is the sole source of Preventative Maintenance and Extended Warranty Service for the Equipment; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and the procurement of the above maintenance service as specified be approved; City of Miami Page 1 of 2 File Id: 11-01182 (Version: 1) Primed On: 12/15/2011 File Number. 11-01182 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained -in therPreamble-to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths), affirmative vote, pursuant to Section 18-92(a)(1) and (3) of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the purchase of Preventative Maintenance and Extended Warranty Service for 911 Workstations, from the Provider, for the Department of Police, is approved, for a term of five (5) years, in an amount not to exceed $68,500, with funds allocated from the Department of Police E9-1-1 Account Code No. 12000.190351.546000.0000.00000, subject to the availability of funds and budgetary approval at the time of need. Section 3. The City Manager is authorized {1 } to execute a Professional Services Agreement, in substantially the attached form, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRUT CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
