HomeMy WebLinkAboutR-12-0002City of Miami Legislation Resolution: R-12-0002 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01194 Final Action Date: 1/12/2012 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "JOINT LAW ENFORCEMENT OPERATIONS TASK FORCE OBLIGATION DOCUMENT," CONSISTING OF COST REIMBURSEMENT OF OVERTIME FOR THE CITY OF MIAMI POLICE DEPARTMENT FELONY APPREHENSION TEAM FROM THE UNITED STATES MARSHALS SERVICE, IN THE AMOUNT OF $90,000, AND PROVIDING AN ADDITIONAL $5,000, FOR FUEL AND MAINTENANCE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE OBLIGATION DOCUMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY OTHER NECESSARY DOCUMENTS IN ORDER TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF SAID FUNDS. WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding with the nited States Marshals Service ("USMS") in August of 2009, for the overtime reimbursement of the City Dlice Department's sworn members participating on the Joint Law Enforcement Operations Task Force Task Force"); and WHEREAS, pursuant to Resolution No. 09-0572, adopted December 17, 2009, the City ommission ratified, approved and confirmed the City Manager's acceptance of a donation from the SMS for two (2) vehicles for use by the City's police officers assigned to the Task Force; and WHEREAS, pursuant to Resolution No. 10-0092, adopted March 11, 2010, the USMS had )ligated an amount not to exceed $70,000, to cover Task Force overtime, for the performance period October 10, 2009 to September 30, 2010; and WHEREAS, pursuant to Resolution No. 11-0032, adopted January 27, 2011, the USMS )nated two (2) additional vehicles for use by the City's police officers assigned to the Task Force; and WHEREAS, the USMS has obligated additional funding reimbursement of overtime for the .riod of October 4, 2011 to September 30, 2012, in an amount not to exceed $90,000, plus $5,000 for el and maintenance of vehicles that were previously donated to the City; and WHEREAS, the reimbursement of overtime work is contingent upon the submission of proper voicing which provides the names of the participating Task Force officers; the number of overtime )urs worked on the Task Force; the hourly regular and overtime pay rates in effect for each Task xrce officer and the total overtime cost for their time worked on Task Force operations; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, _ORIDA: City of Miami Page 1 of 2 File Id: 11-01194 (Version: 1) Printed On: 10/26/2017 File Number: 11-01194 Enactment Number: R-12-0002 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted k reference and incorporated as fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriate as described below: FUND TITLE: Joint Law Enforcement Operations Task Force Obligation Document RESOURCES: United States Marshals Service $95,000 APPROPRIATIONS: Felony Apprehension Team $95,000 Section 3. This City Manager is authorized {1} to execute the Obligation Document, in substantially the attached form, and any other necessary documents in order to implement the acceptance and administration of said funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
