HomeMy WebLinkAboutPre-LegislationsCity of Miami Text File Report City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 09-01329 Enactment #: R-09-0572 Version: 1 Type: Resolution Status: Passed Enactment Date: 12/17/09 Introduced: 11/19/09 Controlling Body: Office of the City Clerk A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S ACCEPTANCE OF A DONATION FROM THE UNITED STATES MARSHALS SERVICE, FOR TWO (2) NEW VEHICLES, FOR THE MEMBERS OF THE CITY OF MIAMI'S DEPARTMENT OF POLICE PARTICIPATING IN THE REGIONAL FUGITIVE TASK FORCE, WITH A VALUE OF $50,000; FURTHER RATIFYING THE CITY MANAGER'S EXECUTION OF THE MEMORANDUM OF UNDERSTANDING, IN SUBSTANTIALLY THE ATTACHED FORM, AND ALL OTHER NECESSARY DOCUMENTS TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF SAID DONATION. WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding ("MOU") with the United States ("U.S.") Marshals Service in August, 2009, for the overtime reimbursement of the City's Department of Police's sworn members participating on the Regional Fugitive Task Force ("Task Force"); and WHEREAS, the MOU required that each participating agency agreed to furnish one vehicle for use by the Task Force for each law enforcement officer assigned to the Task Force; and WHEREAS, recently, the U.S. Marshals Service offered to acquire two (2) new vehicles for use by the two (2) City Department of Police officers assigned to its Task Force; and WHEREAS, each agency is responsible for fuel, maintenance, and other expenses associated with the use of its vehicle; and WHEREAS, this offer was contingent on the City agreeing to accept this offer by signing the "Fiscal Year 2009-Memorandum of Understanding -Regional Fugitive Task Force" between the City Department of Police and the U.S. Marshals Service for the period from August 17, 2009 to September 30, 2009, with a value of $50,000 by September 30, 2009; and WHEREAS, the City Manager executed the MOU to accept said donation, subject to City Commission's ratification; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding ("MOU") with the United States Marshals Service("USMS") in August of 2009 for the overtime reimbursement of sworn members participating in the District Fugitive Task Force ("Task Force") of the City Police Department; and WHEREAS, the MOU stated that should funds be available, the USMS shall reimburse the City for overtime hours - worked pursuant to the MOU; and WHEREAS, the USMS previously reimbursed the City for overtime in an amount not to exceed $3,000, for the performance period of July 1, 2008 to September 30, 2008, and an amount not to exceed $9,000 for the period of December 11, 2008 to September 2009; and WHEREAS, the USMS has obligated overtime reimbursement funding for the period of October 10, 2009 to September 30, 2010, in an amount not to exceed $70,000, surpassing the allotted amount that requires the City Commission's approval, pursuant to Resolution No. 07-0165, adopted March 22, 2007; and WHEREAS, the reimbursement of overtime work is contingent upon the submission of a proper invoice which provides the names of the investigators who incurred overtime for the Task Force during the period indicated above; the number of overtime hours ihcurred; the hourly regular and overtime rates in effect for each investigator and the total cost; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding ("MOU") with the United Marshals Service in August of 2009 for the overtime reimbursement of the City Department of Police's sworn members participating in the Regional Fugitive Task Force ("Task Force"); and WHEREAS, the MOU required that each participating agency agreed to furnish one vehicle for use by each law enforcement officer assigned to the Task Force; and WHEREAS, pursuant to Resolution No. 09-0572, adopted December 17, 2009, the City Commission ratified, approved and confirmed the City Manager's acceptance of a donation from the United States Marshals Service for two (2) new vehicles for use by the City Department of Police's officers assigned to its Task Force; and WHEREAS, recently, the United States Marshals Service donated two (2) additional new vehicles, a 2010 Ford F150 pick-up truck valued at $23,578.45 and a 2011 Ford Edge valued at $23,841.05, for use by the City Department of Police's officers assigned to its Task Force; and WHEREAS, in addition to the donation of these vehicles, the United States Marshals Service has appropriated a total amount of $22,000 for the period covering October 7, 2010, through September 30, 2011, for retrofitting, fuel and maintenance of the four (4) donated vehicles; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.
