A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO
DESTINATION GAMBLING RESORTS AND LICENSE PERMITS FOR SOUTH
FLORIDA GAMBLING LOCATIONS, URGING GOVERNOR RICK SCOTTAND
THE MEMBERS OF THE FLORIDA LEGISLATURE TO SUPPORT LANGUAGE IN
BILLS TO BE PRESENTED BY REPRESENTATIVE ERIK FRESEN AND
SENATOR ELLYN BOGDANOFF DURING THE 2012 LEGISLATIVE SESSION,
SUPPORTING PROVISIONS REQUIRING LOCAL REGULATION AND SITE
APPROVAL FOR DESTINATION GAMBLING RESORTS AND GRANTING
TAXING AND LICENSING AUTHORITY TO THE CITY; DIRECTING THE CITY
CLERK TO TRANSMITA COPY OF THIS RESOLUTION TO THE OFFICIALS
DESIGNATED HEREIN.
WHEREAS, the City of Miami ("City") recognizes the need to increase financial stability within the
State of Florida and also at a local level; and
WHEREAS, during the 2012 Florida Legislative Session Senator Ellyn Bogdanoff and
Representative Erik Fresen plan to file bills that would permit destination gambling resorts in Florida
which would allow for gaming companies to bid on licenses in South Florida, more specifically within
the City of Miami; and
WHEREAS, legalization of destination gabling resorts would provide for job creation and keep the
State of Florida and the City of Miami, economically competitive; and
WHEREAS, the proposed bill will create jobs and economic growth for the State of Florida and
the City of Miami; and
WHEREAS, it is essential that the bill contain provisions whereby the Legislature would authorize
the City to impose and collect excise taxes from the operators of destination gambling resorts on the
gross amount of sales/receipts generated within the corporate limits of the affected municipality; and
WHEREAS, it is essential that the bill contain provisions whereby the City of Miami would
maintain regulatory and zoning rights regarding destination gambling resorts that will fall within the
boundaries of the City of Miami and provisions requiring the approval of any site plan by the local
jurisdiction in which a destination gambling resort is envisioned; and;
WHEREAS, public confidence and trust can only be maintained by strict regulation of all persons,
locations, practices, associations and activities related to the operation of licensed gaming
establishments, and as such the City of Miami would like the proposed legislation to allow for local
implementation of regulatory mechanisms that will ensure and maintain the vision of the proposed
legislation; and

WEREAS, such provisions will maintain the City's current zoning vision as well as allow for
regulatory mechanisms that will promote the continued health, safety, and welfare of the citizens of
the City of Miami and mitigate any negative perceptions of what the future of destination gambling
resorts within the City of Miami will hold, based on the passage of this legislation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission Governor Rick Scott and the members of the Florida
Legislature to support language in bills to be presented by Representative Erik Fresen and Senator
Ellyn Bogdanoff during the 2012 Legislative Session and declares that it is essential that the bill
contain provisions whereby the Legislature would authorize the City to impose and collect excise
taxes from the operators of destination gambling resorts on the gross amount of sales/receipts
generated within the corporate limits of the affected municipality and provide for local regulation and
site approval for destination gambling resorts.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Rick Scott,
the members of the Florida Legislature and the members of the Dade Delegation.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
