FILE NO 11-00116zc The subject proposal seeks to amend the Miami 21 Zoning Atlas and has been reviewed pursuant to Article 7, Section 7.1.2.8 of the Miami 21 Zoning Code, Ordinance 13114, as amended. Application requests: A change to the current zoning classification of T4-0 "General Urban Transect Zone -Open" to T5-0 "Urban Center Transect Zone — Open". The subject property is located within the Coral Way NET area, and consist of five parcels comprising 2.12 acres, located on the West side of SW 27th Avenue, between SW 23rd Street and SW 23rd Terrace as described in Exhibit "A" (Complete legal description is on file with the Hearing Boards Section). Review and analysis of the proposed application finds that: • The subject properties are part of a commercial corridor designated T4-0 "General Urban Zone - Open" along NW 27 Avenue generally bound by SW 22rd Terrace on the north to the north side of SW 26th Street to the south. • This corridor mentioned above is flanked to the east and west by T3-0" Sub -Urban Transect Zone -Open" and T3-R "Sub -Urban Transect Zone - Restricted" • Following are the densities allowed per transects: T3-R "Sub -Urban Transect Zone - Restricted": T 3-0 "Sub -Urban Transect Zone - Open": T4-0 "General Urban Zone - Open": T5-0 "Urban Center Transect Zone - Open": 9 Units per acre 18 Units per acre 36 Units per acre 65 Units per acre • The subject properties have a T4-0 zoning designation and are surrounded by T4-0 to the north, east, and south and by T3-R to the west. • The subject parcels comply with Article 7, Amendment to the Miami 21 Code, 7.1.2.8 a. Successional Zoning. • The character of the corridor at this location is low intensity commercial establishments. The proposed increase in Transect Zone would be out of scale with the remainder of the corridor. Additionally, an increase to T5-0 would permit 65 DU to the acre and does not provide appropriate transition between the proposed T5-0 and the T3-0 neighborhood immediately to the west. • A zoning change at this location may set in motion similar zoning changes in the vicinity that will negatively impact the character of the corridor and surrounding residential neighborhoods. • The proposed zoning designation is consistent with the Miami Comprehensive Neighborhood Plan (MCNP) FLUM designation of Restricted Commercial. ZESKIND Our firm represents South Florida Educational Federal Credit Union (the "Applicant") who is the owner of the properties located at 2728 SW 23 Street, 2720 SW 23 Street, 2710 SW 23 Street, 2719 SW 23 Terrace, and 2729 SW 23 Terrace, and legally described in the attached Exhibit "A" (collectively, the "Property"). The Property is designated Restricted Commercial in the Miami Comprehensive Neighborhood Plan and is zoned T4-O under Miami 21. The Property has direct frontage on the SW 27 Avenue commercial corridor and is just south of the Publix Supermarket. The Applicant is seeking an amendment to the Miami 21 Zoning Atlas from T4-O to T5- 0 in order to introduce a financial institution with accessory drive through facility at the Property. While both the T4-0 and T5-0 transects permit Restricted Commercial uses by Right, drive through facilities are not permitted in the current T4-O transect. As such, the purpose of the rezoning is to allow a drive through facility for a financial institution, in this case a credit union, at the Property. The rezoning request meets the criteria set forth in Sec. 7.1.2.8(c) (1) as Mr. Anel Rodriguez February 7, 2011 Page 2 the request involves a property greater than 40,000 square feet and more than two hundred (200) foot of street frontage. More specifically, the Property is 48,695 square feet and has 292 feet of frontage along SW 27th Avenue. In addition, the change we are seeking meets the successional zone change requirement set forth in Sec. 7.1.2.8(a)(3), be it a rezoning to the next higher transect zone. The purpose of the requests is to allow the Applicant the opportunity to introduce a banking facility with a drive through component at the Property. The Property is an urban infill development site located along one of the City's main thoroughfares. The Property is serviced by existing infrastructure including water, sewer, roads and other utilities. In addition, the Property is in close proximity to the Coconut Grove Metrorail Station as well as a variety of daily retailing and commercial uses such as a Public grocery store directly to the north and medical and professional offices along the SW 27 Avenue corridor. The Applicant does not seek to gain additional density or intensity with this change; instead the purpose is solely limited to the introduction of the drive through component which is otherwise not permitted under the current T4-O transect. Historically properties along this portion of the SW 27 Avenue corridor were zoned Office or Restricted Commercial, both of which allowed for numerous commercial uses as well as the incorporation of drive through banking facilities under Zoning Ordinance 11000. See enclosed map showing portions of Page 42 of prior Zoning Atlas. Upon the implementation of the Miami 21 Code and accompanying Miami 21 Zoning Atlas, the Property was zoned... T5-O and later further down zoned to T4-O in July 2010 as shown in the included map series. The Comprehensive Plan Designation of the Property, however, remains Restricted Commercial, a category often associated with more intense uses more akin to those set forth in the T6-O transect. Notwithstanding the Comprehensive Plan Designation, the Applicants are seeking a zoning change to T5-O which is consistent with the Restricted Commercial Designation as well as the existing development pattern in the area. The existing conditions of the SW 27 Avenue corridor provide for a wide mix of commercial and general retailing that serve the residents of the varying housing types in the area. Further, SW 27 Avenue is one of the main thoroughfares connecting the northern and southern portions of the City of Miami, providing connectivity to US Highway 1 and the Dolphin Expressway (State Road 836), making this a prime corridor for the proper placement of commercial activity.
