A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE
RESCISSION OF THE AWARD TO MCINTYRE MAINTENANCE, INC., PURSUANT
TO INVITATION FOR BID NO. 247232; AND APPROVING THE AWARD OF THE BID
TO GROUNDKEEPERS, INC. (GROUP 1) AND TO BCLS LANDSCAPING GROUP,
INC. (GROUP 2 AND 3), THE SECOND LOWEST RESPONSIVE AND
RESPONSIBLE BIDDERS, FOR THE PROVISION OF GROUNDS MAINTENANCE
SERVICES CITYWIDE, FOR AN INITIAL CONTRACT PERIOD OF TWO (2) YEARS,
WITH THE OPTIONS TO RENEW FOR TWO (2) ADDITIONAL ONE (1) YEAR
PERIODS; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS OF
THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, pursuant to Resolution No. 11-0106, adopted March 10, 2011, the Miami City
Commission awarded a bid to McIntyre Maintenance, Inc., for the provision of grounds maintenance
services Citywide, for an initial contract period of two (2) years, with the option to renew for two (2)
additional one (1) year periods; and
WHEREAS, McIntyre Maintenance, Inc. has failed to perform in accordance with the terms
and conditions of the contract; and
WHEREAS, the Purchasing Department has found them in default of contract, and advised
them of this default on April 22, 2011, pursuant to Sections 1.27 and 2.31 of the contract, and is
therefore recommending the rescission of the award to McIntyre Maintenance, Inc.; and
WHEREAS, the award is recommended to Groundkeepers, Inc. (Group 1) and to BCLS
Landscaping Group, Inc. (Groups 2 and 3), the second lowest responsive and responsible bidders,
under the same prices, terms and conditions pursuant to Invitation for Bid No. 247232;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The rescission of the award to McIntyre Maintenance, Inc., pursuant to Invitation for
Bid No. 247232, is authorized, and the award to Groundkeepers, Inc. (Group 1) and to BCLS
Landscaping Group, Inc. (Group 2 and 3), the second lowest responsive and responsible biders, for
the provision of grounds maintenance services Citywide, for an initial contract period of two (2) years,
with the option to renew for two (2) additional one (1) year periods, is approved, with funds allocated
from the various sources of funds of the user department, subject to the availability of funds and
budgetary approval at the time of need.

Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {1}
Footnotes:
{1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
