HomeMy WebLinkAboutLegislationCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00193 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER 2, ARTICLE II, SECTION 2-33 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED ADMINISTRATION/MAYOR AND CITY COMMISSION/ORDER OF BUSINESS AND RULES OF PROCEDURE", TO PROVIDE FOR SUSPENSION OF THE DISTRIBUTION OF AGENDA ITEMS RULE ONLY BYA MAJORITY PLUS ONE VOTE OF THE CITY COMMISSION; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2, Article II, Section 2-33 of the Code of the City of Miami, Florida, as amended, entitled "Administration/Mayor and City Commission/Order of Business and Rules of Procedure" is amended in the following particulars:{1} "CHAPTER 2 ADMINISTRATION ARTICLE II. MAYOR AND CITY COMMISSION Section 2-33. Order of business and rules of procedure. (a)The rules and regulations regarding the procedure of the city commission at all regular meetings are hereby established and adopted. (e) A copy of each agenda item including each resolution and ordinance and all attachments and back-up material shall be furnished to the mayor and members of the city commission at least five full business days before each regular city commission meeting (five-day rule) with the exception of veto items. This rule shall be deemed suspended unless invoked by a commissioner before the commission takes action on the resolution or ordinance in question. Once the rule is invoked no action can be taken on the resolution or ordinance unless the rule is suspended by unanimous a majority plus one vote of the commissioners present. If only the minimum number of commissioners necessary for a quorum is present, and the rule is invoked, a majority vote will overrule invoking the five-day rule. City of Miami Page 1 of 2 File Id: 11-00193 (Version: 1) Printed On: 5110/2011 File Number: 11-00193 Nonscheduled ("pocket") items may be introduced for consideration at a city commission meeting by the mayor, each commissioner, the city manager and the city attorney provided that the city commission unanimously deems such resolution or ordinance to be of an emergency nature. *„ Section 2. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 3. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE Cl. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
