A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING RETROACTIVELY THE CIVILIAN INVESTIGATIVE PANEL'S
APPOINTMENT AND TERMS AND CONDITIONS OF EMPLOYMENT OF CAROL
A. ABTA AS INTERIM EXECUTIVE DIRECTOR OF THE CIVILIAN INVESTIGATIVE
PANEL.
WHEREAS, the Civilian Investigative Panel ("CUP") was established pursuant to Code
§11.5-26, as an instrumentality of the City of Miami, to provide independent citizens' oversight of the
sworn Department of Police; and
WHEREAS, the "CIP" on January 22, 2009, by majority vote terminated its Executive Director
and temporarily appointed Carol Abia, its then Assistant Director, to serve as interim Executive
Director until an appointment for a new Executive Director; and
WHEREAS, the "CIP" voted to increase the annual salary of Ms. Abia to $135,000; and
WHEREAS, all actions by the "CIP" relating to Ms. Abia's appointment and salary increase
occurred before the City Manager's hiring and promotional freeze effective May 7, 2009;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section: 1. The recitals and findings contained in the Preamble are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The salary set forth by the "CIP" in the attachment to this resolution is approved.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.

{1} The herein authorization is subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those applicable to City Charter and Code
provisions.
{2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten

calendar days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall
become effective immediately upon override of the veto by the City.
