HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-00424 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY, THROUGH THE MIAMI-DADE TRANSIT AGENCY, IN SUBSTANTIALLY THE ATTACHED FORM, TO ACCEPT AND USE FEDERAL TRANSIT ADMINISTRATION ("FTA") SECTION 5307 FORMULA GRANT FUNDS, IN THE AMOUNT OF $4,084,282, ALLOCATED TO THE CITY OF MIAMI ("CITY") BY THE AMERICAN RECOVERY AND REINVESTMENT ACT, FOR A TRANSIT CAPITAL PROJECT CONSISTING OF PURCHASING RUBBER -TIRE TROLLEY BUSES AND ANCILLARY EQUIPMENT; ALLOWING THE CITY TO OPERATE AND MAINTAIN MUNICIPAL CIRCULATOR SERVICES IN THE DOWNTOWN, BRICKELL, HEALTH DISTRICT, ALLAPATTAH, OVERTOWN, AND CORAL WAY NEIGHBORHOODS (B-30668), MIAMI, FLORIDA; IMPLEMENTING THE ACCEPTANCE OF SAID GRANT FUNDS TO BE APPROPRIATED BY SEPARATE RESOLUTION(S). WHEREAS, the City of Miami ("City") applied for a federal grant as part of the federal stimulus package for transit projects; and WHEREAS, Federal Transit Administration ("FTA") Section 5307 funds in the amount of $4,084,282, have been allocated to the City by the American Recovery and Reinvestment Act ("ARRA") for a transit capital project; and WHEREAS, the City's transit project consists of purchasing rubber -tire trolley buses and ancillary capital equipment which will be used to operate municipal circulator services in the Downtown, Brickell, Health District, Allapattah, Overtown, and Coral Way neighborhoods, Miami, Florida; and WHEREAS, Miami -Dade Transit ("MDT") is the designated recipient of federal transit funds in Miami -Dade County and will serve as the local pass -through agency for the FTA Section 5307 funds to be provided to the City by the ARRA; and WHEREAS, an Interlocal Agreement with MDT will be required in order to access the Federal Section 5307 funds to be provided to the City and to allow the City to operate and maintain the proposed municipal circulator services; and WHEREAS, the funding to operate and maintain the municipal circulator services will be provided by the City's share of half -cent transit surtax proceeds (i.e. People's Transportation Plan (PTP) funds); and WHEREAS, no matching funds and no contribution from the General Fund will be required by the acceptance of the federal stimulus/ARRA funds and the execution of this Interlocal Agreement; and WHEREAS, all ensuing agreements and contracts executed pursuant to this resolution will be City of Miami Page 1 of 2 File Id: 10-00424 (Version: 1) Printed On: 7/23/2024 File Number: 10-00424 subsequently brought before the City Commission for approval; and WHEREAS, the federal stimulus/ARRA funds provided by FTA through MDT will be appropriated by separate Resolution(s); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute an Interlocal Agreement with Miami -Dade County, through MDT, in substantially the attached form, to accept and use FTA Section 5307 formula grant funds, in the amount of $4,084,282, allocated to the City by the ARRA, for a transit capital project consisting of purchasing rubber -tire trolley buses and ancillary capital equipment to operate and maintain municipal circulator services in the Downtown, Brickell, Health District, Allapattah, Overtown, and Coral Way neighborhoods, Miami, Florida, and to implement the acceptance of said grant funds to be appropriated by separate resolution(s). Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
