Tornek, a resident and officer thereof, and Gerald Keifer, a resident of the Moorings, by this amended and re- stated appeal, request that the City of Miami Commission review/appeal the approval of a Class II Special Permit by the City of Miami's Zoning Board that has been issued to Skyscraper, LLC, for a Dock and Boardwalk, and as grounds therefore, state as follows: Appellant, The Moorings Property Owners Association, Inc. (hereinafter the "Moorings POA"), is a Florida corporation that is registered with the City of Miami, and Miami -Dade County, Florida, as a property association. The Moorings POA's address is c/o Hermelee & Geffin, Suite 1110, 101 N.E. 3' d Avenue, Ft. Lauderdale, Florida 33301., telephone number 954-764-4445, ATTN: Bruce G. Iermelee, Esq; Mr. Hermelee is the Moorings POA's authorized representative. Lawrence D. Tornek (hereinafter "Tornek"), is a resident of the Moorings, residing at 3455 South Moorings Way, Coconut Grove, FL 33133, and currently the assistant Treasurer of the Moorings POA.Gerald Keifer (hereinafter "Keifer"), is a resident of the Moorings, residing at 3301 South Moorings Way, Coconut Grove, FL 33133, whose property is immediately adjacent to the proposed Dock and Boardwalk. The Moorings POA was established by Plat in 1929. It is a waterfront community located in Coconut Grove, Miami, Florida, currently consisting of 43 single-family residences. The Moorings contains an internal system of roadways and parks, and a boat basin, all of which are in the immediate vicinity of the proposed Board.walk and Dock, and in fact, a portion of the Permitees' property is Lot 14 of The Moorings. A copy of the Revised Plat establishing The Moorings (Plat Book 31, at Page 52, of the Official Records of Miami -Dade County, Florida), is attached hereto as Exhibit A. Notably, the Plat reserves and dedicates to the property owners of The Moorings all of the roadways, parks, common areas, and the boat basin contained within The 101 NE 3"i Avenue, Suite 1110 o Ft. By virtue of such reservation and dedication, all 43 property owners of The Moorings, and particularly those home owners in close proximity to the Permittees' property, are interested and will be affected by the approval of the above -referenced special permit. In fact, the commonly owned property of the Moorings POA, including the waterfront parkland at the tip of South Moorings Way and the boat basin, in addition to no less than eight of the 43 residences of the Moorings, including appellants Kelfer and Tornek, are in direct proximity to the proposed Dock and Boardwalk. The Appellants respectfully disputes the material facts from which the City's Zoning Board premised its decision to grant the special permit. Specifically, the Appellants challenge the measurements regarding the depth of the waters immediately along the shoreline of The Moorings and at the proposed Boardwalk and Dock location as indicated in the Permit. Attached hereto as Exhibit B and incorporated herein by reference is a "Specific Purpose Survey," prepared at the request of the Moorings POA specifically in connection with a Petition brought by the Moorings POA with the Florida Department of Environmental Protection.' The survey was performed by Eddie A. Martinez, Underwater Ecologist, of Zurwelle-Whittaker, Inc., Consulting Engineers & Surveyors. For convenience and ease of reference, in addition to the full-size survey, a reduced -sized copy is also attached hereto. Appellants contend that reversal or modification of the Zoning Board's approval is warranted because the water depth calculations of the subject area are simply incorrect. These incorrect assumptions led to the placing of the Dock virtually in the middle of a high -marine traffic unmarked channel, and as such, present a clear and present danger to marine navigation in this immediate area. The Specific Purpose Survey attached hereto as Exhibit B, indicates clearly that the siting of the Dock permitted by the Zoning Board will present a significant impediment to marine navigation. Appellants contend that the issuance of this Permit is a violation of Chapter 243, Florida Statutes, providing for complete, effective, and proper bases for the issuance of use permits for submerged lands of the State of Florida. The siting of the proposed Dock requires a special exception under the Code of the City of Miami, for a Dock to be placed more than 35 feet offshore. The specific application for this Permit requests a special exception to that requirement, and a siting an additional 23 feet offshore. An examination of current water conditions at the proposed .Dock, as reflected in the Specific Purpose Survey attached hereto as Exhibit B, clearly reflects a siting of the Dock, and the pilings, and boats that may be permitted at the Dock, which poses a significant impediment to marine traffic in what has become a highly used coastal unmarked channel in the most densely populated area of the Slate of Florida. The Appellants respectfully suggests that the pendency of such Petition with the Department of Environmental Protection also warrants that the City Commission reverse or modify the approval of the subject special permit by the Zoning Board. 101 NE 3" Avenue, Suite 1110 e Ft. The unmarked channel shown on the Specific Purpose Survey immediately in front of the Permittees' property, appears to be not much more than 100 feet in width. The Dock structure and the pilings, allowing for the vessels that will be permitted to be at the Dock, should be sited close enough to the shoreline, to allow safe passage through this unmarked channel.
