HomeMy WebLinkAboutAnalysisANALYSIS FOR SPECIAL EXCEPTION Mr. AND Mrs. BERNARDO & LAURINDA FORT -SPEAR NEW DOCK AND WALKWAY 3300 SOUTH MOORINGS WAY MIAMI, FLORIDA CASE NO: 09-00800X APPLICATION FOR SPECIAL EXCEPTION PERMIT SUBJECT TO COMPLIANCE WITH ZONING ORDINANCE 11000 AND CITY CODE, AS AMENDED, AND ALL APPLICABLE CRITERIA, CONSIDERATIONS AND/OR OTHER REGULATIONS. Pursuant to Ordinance 11000, as amended, Supplement 14, the Zoning Ordinance of the City of Miami Florida, the subject proposal for Mr. AND Mrs. BERNARDO & LAURINDA FORT -SPEAR NEW DOCK AND WALKWAY at 3300 SOUTH MOORINGS WAY MIAMI, FL, has been submitted and reviewed to allow an application for Special Exception Permit, subject to all applicable criteria; 4...j The proposed development "Mr. AND Mrs. BERNARDO & LAURINDA FORT -SPEAR NEW DOCK AND WALKWAY" will consists of; approximately 212 square feet of Access Walkway, 160 square feet of Terminal Platform, 653.4.5 square feet of Slip #1, 208 square feet of Slip #2, all these structures over State submerge land, and 1,407 square feet of Access Walkway structure upland. Access Walkway and Terminal Platform over State submerge land will extend a distance of approximately 58 lineal feet into the Biscayne Bay as depicted on design plans sheets D-1, D-2 & D-3. SPECIAL EXCEPTION, as per Article 9, Section 924.11, to allow extensions of docks and piers into waterways extending more than 35 feet in length; This SPECIAL EXCEPTION PERMIT encompasses the following Special Permits: CLASS II SPECIAL PERMIT, as per ARTICLE 15, Section 1511, to allow a new development on property located between Biscayne Bay and first dedicated right-of-way is required. However, a Class II (File No. 2009-0160) has been submitted separate. The following findings have been made: • It is found that the proposed development "Mr. AND Mrs. BERNARDO & LAURINDA FORT -SPEAR NEW DOCK AND WALKWAY" will consists of; approximately 212 square feet of Access Walkway, 160 square feet of Terminal Platform, 653.4.5 square feet of Slip #1, 208 square feet of Slip #2, all these structures over State submerge land, and 1,407 square feet of Access Walkway structure upland. • It is found that the access Walkway and Terminal Platform over State submerge land will extend a distance of approximately 58 lineal feet into the Biscayne Bay as depicted on design plans sheets D-1, D-2 & D-3 which requires a Special Exception. • It is found that the access Walkway and Terminal Platform is appropriate at this site. • It is found that a subordinate Class II Special Permit as per Article 15, Section 1511 to the Special Exception has been submitted separately and reviewed under File No. 2009-0160 to allow the construction of a new single home. • It is found that the subordinate Class II Special Permit 2009-0160 has been reviewed and approved with conditions. Based on these findings, the Planning Department is recommending approval of the requested project as presented. Pursuant to Section 1305.2 of the Zoning Ordinance, the specific site plan aspects of the PROJECT that have been found by the City Commission (based upon facts and reports prepared or submitted by staff or others) to adhere to the following Design Review Criteria subject to the any applicable conditions in the Development Order herein: I) Site and Urban Planning: Design Review Criteria Applicability (1) Respond to the physical _Y contextual environment taking into consideration urban form and natural features; (2) Siting should minimize the N/A impact of automobile parking and driveways on the pedestrian environment and adjacent properties; (3) Buildings on corner lots _N/A_ should be oriented to the corner and public street fronts. Compliance II) Architecture and Landscape Architecture: Y Design Review Criteria Applicability Compliance (1) A project shall be designed _N/A_ to comply with all applicable landscape ordinances; (2) Respond to the neighborhood N/A context; (3) Create a transition in bulk N/A and scale; (4) Use architectural styles N/A and details (such as roof lines and fenestration), colors and materials derivative from surrounding area; (5) Articulate the building facade N/A vertically and horizontally in intervals that conform to the existing structures in the vicinity. Where blank walls are unavoidable, they should receive design treatment. V) Vehicular Access and Parking: Design Review Criteria Applicability (1) Design for pedestrian and N/A_ vehicular safety to minimize conflict points; (2) Minimize the number and N/A width of driveways and curb cuts; (3) Parking adjacent to a street N/A front should be minimized and where possible should be located behind the building; (4) Use surface parking areas _N/A_ as district buffer. When elements such as dumpsters, utility meters, mechanical units and service areas cannot be located away from the street front they should be situated and screened from view to street and adjacent properties; (3) Screen parking garage _N/A_ structures with program uses. Where program uses are not feasible soften the garage structure with trellises, landscaping, and/or other suitable design element. VII) Signage and Lighting: Design Review Criteria Applicability (1) Design signage appropriate N/A_ for the scale and character of the project and immediate neighborhood; (2) Provide lighting as a design N/A_ feature to the building facade, on and around landscape areas, special building or site features, and/or signage; (3) Orient outside lighting to _ N/A_ minimize glare to adjacent properties; (4) Provide visible signage _ N/A identifying building addresses at the entrance(s) as a functional and aesthetic consideration.
