HomeMy WebLinkAboutOrdinanceCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-00317 Final Action Date: 4/8/2010 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 62/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ZONING AND PLANNING/PLANNING ADVISORY BOARD," MORE PARTICULARLY BY AMENDING SECTION 62-61 ENTITLED "ESTABLISHMENT", TO CHANGE THE NUMBER OF VOTING MEMBERS FOR THE PLANNING ADVISORY BOARD FROM NINE TO ELEVEN, WITH THE MAYOR APPOINTING ONE MEMBER; AND AMENDING ARTICLE V/SECTION 62-122 ENTITLED "APPOINTMENT OF MEMBERS AND ALTERNATE MEMBERS OF THE PLANNING ADVISORY BOARD AND ZONING BOARD/SIZE OF BOARDS AND TERMS OF OFFICE", TO CONFORM; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 62 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:{1} "CHAPTER 62 ZONING AND PLANNING ARTICLE III. PLANNING ADVISORY BOARD Sec. 62-61. Establishment. There is hereby established a board, to be known as the city planning advisory board. The planning advisory board shall consist of nine eleven voting members, ten to be appointed by the city commission, and one alternate member to be appointed by the Mayor in the manner hereinafter set out in article V of this chapter, and one ex-officio, non -voting member appointed by the school board. The school board appointee, serving as an ex-officio, non -voting member, shall be invited to attend such meetings at which comprehensive plan amendments and re -zonings are considered which, if granted, increase residential density. The school board appointee shall not be counted in determining whether a quorum is present at any meeting and is exempt from all of the provisions of article V of this chapter. APPOINTMENT OF MEMBERS AND ALTERNATE MEMBERS OF THE PLANNING ADVISORY BOARD AND ZONING BOARD Sec. 62-122. Size of boards and terms of office. The planning advisory board and the zoning board shall ach consist of nine eleven voting members,_ ten to be appointed by the city commission, and one alternate member to be appointed by the Mayor, and the zoning board shall consist of nine voting members and one alternate member to be appointed by the city commission in the manner and under the standards hereinafter set out. Each member and or alternate member shall be appointed for a term of one year or until the nominating commissioner leaves office, whichever occurs first. Notwithstanding the above, however, members of the planning advisory board and zoning board may continue to serve, after their respective terms of office expire, subject to reappointment or to a new appointment to a new term of office by the city commission. * I I Section 2. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 3. This Ordinance shall become effective immediately after final reading and adoption thereof. {2) Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
