Law Department Matter ID No. A Resolution of the Miami City Commission authorizing the award for the procurerner t of a Traffic Safety Camera Program to American Traffic Solutions ("ATS"), the third ranked firm, pursuant to RFP 119057, and further authorizing the City Manager to negotiate and execute an agreement, in substantially the attached form, with ATS for a period of five (5) years, with the option to extend for two (2) additional two (2) year periods, as a result of the City Commission's approval pursuant to Resolution No. 10-0110, of the Chief Procurement Officer's decision to uphold the protest of American Traffic Solutions and rejecting the City Manager's concurrence with the Evaluation Committee's recommendations and finding which would have allowed competitive negotiations with the first -ranked firm ACS State & Local Solutions, Inc., and that should negotiations fail, to then negotiate with the second -ranked firm, Redflex Traffic Systems, Inc. Further authorizing the City Manager to renegotiate said agreement with ATS should the State Legislature pass any legislation that would impact the City's Traffic Safety Camera Program in order to be in compliance with said State law. Director , 1f) AGENDA ITEM SUMMARY FORM (CONTINUED): SUBJECT: Request for Proposal (RFP) 119057, Traffic Safety Camera Program BACKGROUND INFORMATION: The Department of Purchasing issued Request for Proposal ("RFP") No. 119057, for the procurement of a Traffic Safety Camera Program. Five (5) proposals were received and deemed responsive. The Evaluation Committee appointed by the City Manager ranked all five (5) firms responsive and recommended that the City negotiate with the top ranked firm, ACS State & Local Solutions, Inc., and further recommended that should negotiations fail with the top ranked firm that the City then negotiate with the second ranked firm, Redflex Traffic Solutions, Inc. On April 29, 2009, all five (5) proposers were sent official notice of the City Manager's recommendation for award of this contract in accordance with § 18-104 of the City Code. Pursuant to Section 18-104 of the City Code, entitled "Resolution of Protested Solicitations and Awards", American Traffic Solutions ("ATS") timely submitted a written notice of intent to file a protest and written protest with the necessary filing fee. Thus, pursuant to § 18-104 of the City Code, a stay in the procurement during protest occurred to resolve the many legal issues surrounding this procurement, including the protest itself. The City Manager authorized for an independent professional assessment (due diligence) to be conducted by a technical expert in the area of red light photo enforcement equipment because the Purchasing Department lacked said expertise. The services of HNTB were acquired to conduct the independent professional assessment/due diligence review to determine whether the claims raised by ATS in its bid protest of ACS and Redflex non - responsibility were valid. HNTB independently confirmed said claims, and the Chief Procurement Officer determined based on the independent findings submitted by HNTB deemed both ACS and Redflex non - responsible firms solely based on the fact when the Request for Proposals was issued and at the time responses were submitted by ACS and Redflex for the Traffic Safety Camera Program, both firms "at that point time" had not installed a fully operational self-sustaining, free-standing, non -intrusive, non-physical camera system to a Traffic Control System as required by the specifications of the RFP . On March 11, 2010, the City Commission pursuant to Resolution No. 10-0110, approved the Chief Procurement Officer's decision to uphold the protest of American Traffic Solution ("ATS") and rejecting the City Manager's concurrence with the Evaluation Committee recommendations and finding which would have allowed competitive negotiations with the first -ranked firm ACS State & Local Solutions, Inc., and that should negotiations fail, to then negotiate with the second -ranked firm, Redflex Traffic Systems, Inc. As a result of the above, this resolution is authorizing the award for the procurement of a Traffic Safety Camera Program, to American Traffic Solutions ("ATS"), pursuant to Request for Proposal ("RFP") No. 119057, and further authorizing the City Manager to enter into negotiations and execute an agreement, in substantially the attached form, with the third -ranked firm, American Traffic Solutions ("ATS"), for a period of five (5) years, with the option to renew for two (2) additional two (2) year periods; further, authorizing the City Manager to renegotiate said agreement between the City and ATS should the State Legislature pass any legislation that would impact the City's Traffic Safety C-am u-be-in-compliance-with-S#ate-law.
