A RESOLUTION OF THE MIAMI CITY COMMISSION DECLARING AN EXEMPTION
FROM THE PROHIBITIONS AND RESTRICTIONS CONTAINED IN SECTIONS
36-4(A) AND 36-5 (A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, AS RELATED TO THE LEVEL AND HOURS OF NOISE RESULTING
FROM EL CARNAVAL DE BARRANQUILLA, ON FRIDAY, FEBRUARY 19, 2010,
FROM 9:00 P.M. THROUGH 3:00 A.M., AT 140 NORTHEAST 39TH STREET,
MIAMI, FLORIDA.
WHEREAS , on February 19, 2010, El Carnaval De Barranquilla was held at 140 Northeast 39th
Street, Miami, Florida, from, approximately, 9:00 pm - 3:00 am; and
WHEREAS, § 36-4 of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits
loud, unnecessary, excessive or unusual noises; and
WHEREAS, § 36-5 of the City Code prohibits the operating or playing of music boxes, jukeboxes,
radios, musical instruments and other devices between the hours of 11:00 pm - 7:00 am; and
WHEREAS, §§ 36-4 and 36-5 of the City Code provides that the City Commission may exempt by
Resolution the prohibitions contained in the subject ordinances for special occasions; and
WHEREAS, El Carnival De Barranquilla is a special occasion; held annually; and
WHEREAS, the City Commission wishes to grant an exemption for the event;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. An exemption from the prohibitions and restrictions contained in Sections 36-4(a) and
36-5 (a) of the Code of the City of Miami, Florida, as amended, as related to the level and hours of
noise resulting from El Carnaval de Barranquilla, on Friday, February 19, 2010, from 9:00 p.m.
through 3:00 a.m., at 140 Northeast 39th Street, Miami, Florida, is declared.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
