Our film represents RMM Properties, LTD. who is the owner (the "Owners") of the
property located at 711 SW 39 Avenue (the "Property"). The Property is designated Single
Family Residential in the Miami Comprehensive Neighborhood Plan (the "Comp Plan") and is
zoned R-1 single family. The Owner is proposing a change to the Miami Comprehensive
Neighborhood Plan from Single Family Residential to Restricted Commercial and a zoning
change from R-1 Single Family to C-1 Restricted Commercial.
The Property is surrounded by commercial uses on the east, west, and south. Directly to
the west is the Navarro Discount Pharmacy site and parking area. To the south is a commercial
office building and to the east there is a commercial office tower. The parking uses for the
abutting commercial sites directly face the Property and create undesirable effects for residential
occupants such as excess noise and light. Please see the enclosed photos of the site and
immediate area. The land use and zoning change we are seeking is a logical extension of the
abutting district boundary line and will provide consistent commercial zoning for the immediate
area.
