RE: Proposed Resolution for City Commission Meeting — November 19,
2009
Initiating conflict resolution procedures provided by Chapter 164 Florida
Statutes, in connection with Miami -Dade County's refusal to pay parking
surcharge fees to the City of Miami.
The attached proposed Resolution seeks authorization to initiate conflict resolution
procedures provided by Chapter 164 Florida Statutes, in connection with Miami -Dade County's
refusal to pay parking surcharge fees to the City of Miami
Background
The City of Miami imposes and levies a surcharge on the sale, lease or rental of space at
parking facilities in the City of Miami. Miami -Dade County operates parking facilities subject to
this surcharge in the City of Miami. The County however, has failed to pay sums due to the City
relating to this surcharge. Florida law requires that before instituting suit against a County, a
Municipality must initiate certain conflict resolution procedures set forth in Chapter 164 Florida
Statutes. Therefore, this resolution is necessary to comply with Florida law.
