HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 09-01180 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND AMENDMENT TO CONSTRUCTION ADMINISTRATION AGREEMENT AMONG MIAMI-DADE COUNTY ("COUNTY"), THE MARLINS STADIUM DEVELOPER, LLC AND THE CITY OF MIAMI, IN SUBSTANTIALLY THE ATTACHED FORM, TO REDUCE THE COUNTY'S FUNDING COMMITMENT AND THE INITIAL STADIUM PROJECT BUDGET, BY $6,200,000. WHEREAS, Miami -Dade County ("County"), the Marlins Stadium Developer, LLC (the "Stadium Developer") and the City of Miami ("City") entered into a Construction Administration Agreement dated April 15, 2009, as amended by the First Amendment to Construction Administration Agreement dated June 30, 2009, approved by the City Commission pursuant to Resolution No.09-131, adopted March 19, 2009 and Resolution No. 09-0304, adopted June 18, 2009, respectively (the "CAA"); and WHEREAS, pursuant to Resolution No. R-905-09, adopted July 1, 2009, the Board of County Commissioners of Miami -Dade County approved a Second Amendment to the CAA that reduces the County's funding commitment, and the initial Stadium Project Budget, by $6,200,000; and WHEREAS, in order to execute the Second Amendment it is necessary to obtain the approval of the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and finding s contained in the preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute the Second Amendment to the CAA among the County, the Stadium Developer and the City, in substantially the attached form, to reduce the County's funding commitment, and the initial Stadium Project Budget, by $6,200,000. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miami Page 1 of 2 File Id: 09-01180 (Version: 1) Printed On: 9/26/2024 File Number: 09-01180 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
