HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 09-01152 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE DOWNTOWN DEVELOPMENT AUTHORITY TO EMPLOY OR RETAIN ITS OWN COUNSEL FOR LEGAL SERVICES OR IN THE ALTERNATIVE, COMPENSATE THE CITY ATTORNEY FOR LEGAL SERVICES RENDERED BY THE CITY ATTORNEY; ESTABLISHING A SPECIAL REVENUE FUND ENTITLED: "OFFICE OF THE CITY ATTORNEY LEGAL SERVICES FEES COLLECTED FROM OUTSIDE AGENCIES," FOR THE APPROPRIATION OF SAID FUNDS COLLECTED. WHEREAS, Article II, Section 14-56(b)(7) of the Code of the City of Miami ("City") requires that the Downtown Development Authority ("DDA") retain and fix the compensation of legal counsel to advise the DDA in the proper performance of its duties; and WHEREAS, the City Attorney has served as the legal counsel for the DDA without compensation; and WHEREAS, pursuant to the City Attorney's Executive Summary for January 1, 2008 through June 30, 2009, the City Attorney advised that due to 2009-2010 budget challenges resulting in reduced legal staffing, legal services will be discontinued for certain agencies, authorities and boards; and WHEREAS, should the DDA desire to retain the legal representation of the City Attorney, effective October 1, 2009, the DDA will pay to the City Attorney (City) legal fees for such services in the amount of $175 per hour, plus costs and expenses associated with such representation; and WHEREAS, a special revenue fund entitled "Office of the City Attorney Legal Services Fees Collected from Outside Agencies" is created for the appropriation of said funds collected; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The DDA is authorized to employ or retain its own counsel for legal services or in the alternative, compensate the City Attorney for legal services rendered by the City Attorney. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
