Final Action Date:
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AFTER A PUBLIC HEARING, ACCEPTING THE RECOMMENDATIONS OF THE
GROVE AREA TRAFFIC CALMING STUDY, DATED MAY, 2008, PREPARED BY
MARLIN ENGINEERING, INC.; ACCEPTING THE RECOMMENDATION OF A
TRAFFIC CIRCLE AT THE INTERSECTION OF MATILDA STREET AND DAY
AVENUE, MIAMI, FLORIDA ("PROJECT"); REQUESTING THAT THE MIAMI-DADE
COUNTY TRAFFIC ENGINEERING DIVISION APPROVE THE IMPLEMENTATION
OF THE PROJECT.
WHEREAS, at the request of the Coconut Grove neighborhood, the Capital Improvements
Program ("CIP") performed a traffic calming study; and
WHEREAS, the CIP secured the services of Marlin Engineering, Inc. ("Engineer") to collect
existing traffic information to address traffic conditions and residents' concerns; and
WHEREAS, the study recommended the installation of a traffic circle at the intersection of Matilda
Street and Day Avenue, Miami, Florida, which will reduce vehicular speeds, minimize traffic intrusion
and reduce vehicular conflicts at said location; and
WHEREAS, the Miami -Dade County Department of Public Works Traffic Engineering Division
("MDCTED") preliminarily approved the findings of the traffic calming study, approving, with conditions,
the recommendation of a traffic circle for the intersection of Matilda Street and Day Avenue, Miami,
Florida ("Project"); and
WHEREAS, the MDCTED approval is subject to the City of Miami obtaining concurrence from
affected agencies and affected residents and property owners; and
WHEREAS, concurrence was obtained from the affected agencies of Fire, Police, Solid Waste,
and Miami -Dade County Public Schools; and
WHEREAS, a ballot process performed in March, 2009, failed to obtain consensus from the
required 100% of residents and property owners directly adjacent to the proposed modification; and
WHEREAS, MDCTED procedures for traffic flow modification establish that in lieu of concurrence
from affected residents and property owners, a municipality may pass a Resolution, after a public
hearing, requesting MDCTED to consider the proposed traffic flow modification; and
WHEREAS, this Resolution is required in order to obtain final approval from MDCTED to
implement the recommendations of the traffic study;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,

FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. After a public hearing, the recommendations of The Grove Area Traffic Calming Study,
dated May, 2008, prepared by the Engineer, are accepted.
Section 3. The City Commission accepts the recommendation of the Project and requests that the
MDCTED approve the implementation of the Project.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
