HomeMy WebLinkAboutCC Legislation (Version 1) - OLDFile Number: 07-0034Sww City 0 Legislation Resolution City Ha E 3500 Pan American Drive • Miami, EL 33133 W W.miarnigOv.COr Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING FINDINGS AND APPROVING A MODIFICATION OF THE REQUIRED WATERFRONT CHARTER PROVISIONS RELATING TO THE SETBACK, AS SET FORTH IN SECTION 3(mm)(ii-iv) OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FROM 50 FEET 0 INCHES TO 22 FEET 6 INCHES TO THE NEAREST POINT BETWEEN THE NEW STRUCTURE AND THE BULKHEAD, FOR THE GROVE HARBOUR MARINA AND MARKETPLACE PROJECT, TO BE LOCATED AT APPROXIMATELY 2640 SOUTH BAYSHORE DRIVE, MIAMI, FLORIDA. WHEREAS, on June 24, 2008, Felix Lima, Principal, and Juan Berry, Architect, on behalf of the Grove Harbour Marina, submitted a request for a modification pursuant to the waterfront charter requirement set forth in Section 3(mm)(ii-iv) of the Charter of the City of Miami, Florida, as amended ("Charter"), to permit the setback modification from 50 feet 0 inches to 22 feet 6 inches to the nearest point between the new structure and the bulkhead for the Grove Harbour Marina and Marketplace project ("Project"), to be located at approximately 2640 South Bayshore Drive, Miami, Florida, as legally described in "Exhibit A," attached and incorporated; and WHEREAS, the Miami Waterfront Advisory Board, at its meeting on September 9, 2008, following an advertised public hearing, adopted Resolution No. WAB-08-10 by a vote of six to zero (6-0), recommending APPROVAL with conditions, as imposed by the Zoning Board on September 8, 2008; and WHEREAS, said charter modification requires City Commission approval; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to approve the requested waterfront Charter modification as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission finds that the Project complies with the criteria for a modification pursuant to waterfront charter provisions relating to the setback, as set forth in Section 3(mm)(ii-iv) of the Charter and approves the modification from 50 feet 0 inches to 22 feet 6 inches to the nearest point between the new structure and the bulkhead, for the Project, to be located at approximately 2640 South Bayshore Drive, Miami, Florida, as legally described in "Exhibit A," attached and incorporated.
