HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00218 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO CONVEY, WITH PARCEL REVERTER PROVISIONS, TWO (2) CITY OF MIAMI OWNED PARCELS OF LAND, LOCATED AT 6200 NORTHWEST 17 AVENUE AND 6201 NORTHWEST 17 AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, DIRECTLY TO CARRFOUR SUPPORTIVE HOUSING, INC., FOR THE DEVELOPMENT OF AFFORDABLE HOUSING; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE PURCHASE AND SALE AGREEMENT(S), IN THE ATTACHED FORM(S), WITH SAID ENTITY FOR SAID PURPOSE. WHEREAS, on October 31, 2007, the City of Miami ("City") issued a request for proposals ("RFP"), inviting qualified private real estate developers to propose developments to create mixed- use, affordable rental housing on two (2) City -owned parcels located at 6200 Northwest 17 Avenue and 6201 Northwest 17 Avenue, Miami, Florida ("Parcels"); and WHEREAS, the due date to submit the RFP was November 30, 2007; and WHEREAS, a total of three (3) responses were received and all met the minimum threshold requirements; and WHEREAS, the responses were reviewed by an Evaluation Committee comprised of a resident of the Liberty City area, a representative of the Liberty City Community Revitalization Trust and an employee of the City Department of Community Development; and WHEREAS, Carrfour Supportive Housing, Inc. ("Carrfour") received the highest average point score of the three responses; and WHEREAS, the Administration is recommending the conveyance, with parcel reverter provisions, of the two (2) City -owned Parcels of land, legally described in Exhibit "A," attached and incorporated, to Carrfour for the development of affordable housing; and WHEREAS, Carrfour is a not -for -profit organization founded in 1993 by the Homeless Committee of the Greater Miami Chamber of Commerce, and its mission is to provide permanent housing supportive services to maximize the self-sufficiency of the formerly homeless in Miami -Dade County and other cities in Florida through joint ventures with various non-profit organizations; and WHEREAS, Carrfour is in good standing with the City; and WHEREAS, the properties will be conveyed through purchase and sale agreements City of Miami Page 1 of 2 Printed On: 2/29/2008 File Number: 08-00218 ("Agreements"); and WHEREAS, to convey said properties, the City must receive from the developer the following: (i) evidence that the developer has received all necessary permits needed to construct the units, (ii) evidence that financial commitments from the lenders) has been received, (iii) any mortgages obtained by the developer on the property will be subject to the approval of the City Department of Community Development, and (iv) the closing of the Agreements will occur simultaneously with the closing of the construction financing by the lender, if any; and WHEREAS, the properties conveyed will have the following restrictions: (i) all the units must be sold to households with incomes not to exceed 80% of the median household income for Miami -Dade County, as published annually by Florida Housing Finance Corporation, (ii) the properties must remain affordable for a minimum of 20 years, (iii) the properties may not be used as collateral by the developer without written permission from the City, and (iv) the dosing of the Agreements must occur simultaneously with the closing of the construction financing by the lender, if any; and WHEREAS, Carrfour will have six (6) months from the date of land conveyance to begin construction and will have an additional twenty-four (24) months to complete construction; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to convey, with parcel reverter provisions, the two (2) City -owned parcels of land, legally described in Exhibit "A," attached and incorporated, to Carrfour for the development of affordable housing. Section 3. The City Manager is further authorized {1} to execute an Agreement(s), in substantially the attached form(s), with Carrfour, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: MARIA J. CHIAR �y INTERIM CITY ATTORNEY Footnotes: (1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
