Confirm adoption of Ordinance 12948, regarding DDA Millage, by una.nimous vote
The item being presented for your consideration on the October 25, 2007, City
Commission meeting is a re -vote of Ordinance 12948, adopted on September 27, 2007, fixing
the millage of the Downtown Development Authority. The Ordinance, which adopted a
millage at the same rate that was levied in the 2006-2007 fiscal year, was adopted unanimously
by the Commissioners present during the hearing of this item. However, one member of the
Commission had left the dais at the time of the vote.
Pursuant to the new TRIM bill (Section 200.185(4), F.S.), an "independent special
district" may adopt the millage rate that was levied in the 2006-2007 fiscal year, if approved by
a unanimous vote of the governing body of said district. The Department of Revenue has taken
the position, informally, that the absence of a commissioner from the dais when the vote was
taken fails to constitute "unanimous vote", and has recommended that a re -vote be taken to
clarify this issue.
