Subject: Invitation to Bid - Fuel Services Maintenance
Purpose of Item:
The nature of this item is to establish a resolution of the Miami City Commission, authorizing
the accessing of Miami -Dade County's ("MDC") Invitation to Bid ("ITB") No. FB-01793 for Fuel
Service Station Maintenance, Repair, and Services, on an as needed basis, pursuant to
Section 18-111 of the Code of the City of Miami, Florida, as amended, with Cherokee
Enterprises, Inc. ("Cherokee"), Genesis Global LLC ("Genesis"), Gulfstream Petroleum
Services, Inc. ("Gulfstream"), Florida Metro Construction Company, Inc. ("Florida Metro"), and
Lutz Petroleum Equipment Installations, Inc. ("Lutz") which was competitively solicited for an
initial term of five (5) years, with no options to renew and will expire July 26, 2026; subject to
any renewals, extensions and/or replacement contracts by MDC; allocating funds from the City
of Miami's General Services Administration Department's ("GSA") Expansion Services and
General Fund Accounts subject to the availability of funds and budgetary approval at the time
of need; authorizing the City Manager to execute Supplemental Agreements to MDC Contract
No. FB-01793 in a form acceptable to the City Attorney; further authorizing the City Manager to
negotiate and execute any and all documents, including any amendments, renewals, and/or
extensions; subject to all allocations, appropriations, and budgetary approvals having been
previously made, compliance with applicable provisions of the Code of the City of Miami,
Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance,
Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City
Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws,
rules, and regulations, as may be deemed necessary for said purpose.
Background of Item:
GSA has a need to replace two (2) fuel service station tanks and maintain services, on an as
needed basis. The City has outgrown the current system and is in need of larger fuel tanks to
meet the needs of the various City departments. Market research was conducted to gauge the
market for said services. During the search it was found that Miami -Dade County had a
contract in place for fuel service station maintenance, repair and services, which was
competitively solicited under full and open competition, meeting all of the City's criteria for
accessing the contract. It was determined that accessing MDC Contract No. FB-01793, will
enable the City to procure the services of installation and maintenance of the fuel service
station, at a fair competitive rate that is acceptable to the City. It is recommended that the City
access this contract in order to benefit from the cost savings resulting from economies of
scales. The estimated contract amount is approximately $1,000,000.00.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE
ACCESSING THE MIAMI-DADE COUNTY ("MDC") INVITATION TO BID ("ITB")
CONTRACT NO. FB-01793 FOR FUEL SERVICE STATION MAINTENANCE, REPAIR,
AND SERVICES (THE "CONTRACT"), ON AN AS NEEDED BASIS, PURSUANT TO
SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("CITY CODE"), WITH CHEROKEE ENTERPRISES, INC., GENESIS GLOBAL LLC,
GULFSTREAM PETROLEUM SERVICES, INC., FLORIDA METRO CONSTRUCTION
COMPANY, INC., AND LUTZ PETROLEUM EQUIPMENT INSTALLATIONS, INC.
(COLLECTIVELY "CONTRACTORS"), WHICH WAS COMPETITIVELY SOLICITED
FOR AN INITIAL TERM OF FIVE (5) YEARS, EXPIRING ON JULY 26, 2026,
INCLUDING ANY EXTENSIONS AND/OR REPLACEMENT CONTRACTS BY MDC;
ALLOCATING FUNDS FROM THE CITY OF MIAMI'S GENERAL SERVICES
ADMINISTRATION DEPARTMENT'S ("GSA") EXPANSION SERVICES AND
GENERAL FUND ACCOUNTS, SUBJECT TO AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE SUPPLEMENTAL AGREEMENTS WITH
THE CONTRACTORS FOR THE CONTRACT IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ALL OTHER NECESSARY DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND/OR EXTENSIONS, ALL IN FORMS ACCEPTABLE
TO THE CITY ATTORNEY, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS
AND PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH APPLICABLE
PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY OF MIAMI'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES AND
REGULATIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the General Services Administration Department ("GSA") has a need to
purchase two (2) replacement fuel service station tanks and maintenance services, on an as
needed basis; and
WHEREAS, the accessing of the Miami -Dade County, Invitation to Bid Contract No. FB-
01793 for Fuel Service Station Maintenance, Repair, and Services with Cherokee Enterprises,
Inc., Genesis Global LLC, Gulfstream Petroleum Services, Inc., Florida Metro Construction
Company, Inc., and Lutz Petroleum Equipment Installations, Inc. (collectively "Contractors")
which were competitively solicited for an initial term of five (5) years, all expiring on July 26,
2026 (the "Contracts"), will enable GSA to procure said goods and services at a fair competitive
rate that is acceptable to the City; and
WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as
amended, the Chief Procurement Officer determined that said Contracts were entered into,
pursuant to a competitive process in compliance with the City's laws, policies and procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The accessing of the Contracts, including any extensions and/or replacement
contracts by MDC, is hereby authorized1.
Section 3. Funding shall be allocated from the various sources of funds from GSA
Department Budget and General Funds, subject to availability of funds and budgetary approval,
at the time of need.
Section 4. The City Manager is authorized' to execute Supplemental Agreements with
each Contractor, all in forms acceptable to the City Attorney.
Section 5. The City Manager is further authorized' to negotiate and execute all other
necessary documents, including any amendments, renewals, and/or extensions, all in forms
acceptable to the City Attorney, subject to all allocations, appropriations and prior budgetary
approvals, compliance with applicable provisions of the City Code, including, the City of Miami's
Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, all in forms acceptable to the City Attorney, and in compliance with
all applicable laws, rules and regulations.
Section 6. This Resolution shall become effective immediately upon its adoption.
