Fernan ) orney DATE: August 27, 2007 RE: Proposed Resolution -September 11, 2007 City Commission Meeting Approving, setting forth and submitting to the electorate a proposed „charter amendment to establish a Citizens' Bill of Rights in the City Charter. (File 07-00438b) The Miami -Dade County Charter contains a Citizens' Bill of Rights that is applicable to municipalities in Miami -Dade County. On May 10, 2007, the City Commission adopted Resolution No. 07-0276, thereby directing the City Attorney to prepare a proposed charter amendment that would establish a Citizens' Bill of Rights in the City Charter that would contain some of the same provisions found in the Miami -Dade County Charter as well as certain provisions not presently contained in the Miami -Dade County Charter. The Resolution calls for and directs a Special Municipal Election to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M., on Tuesday, January 29, 2008, for the purpose of submitting to the qualified electors of the City of Miami for their approval or disapproval the measure known as Charter Amendment No. 1. The ballot language would read as follows: "Shall the Miami Charter be amended to establish a Citizens' Bill of Rights to guarantee access to government, truth in government, access to public records, maintenance of minutes and ordinance register, right to be heard, right to notice, right to public hearing, no unreasonable postponements, prompt notice of actions and reasons, Manager's and City Attomey's reports, conservation and protection of natural resources and scenic beauty, and nondiscrimination, and providing for remedies and construction?"
