A RESOLUTION OF THE MIAMI CITY COMMISSION, DIRECTING THE CITY
MANAGER TO IMPLEMENT A POLICY REQUIRING THAT ALL REQUEST FOR
LETTERS OF INTEREST, REQUEST FOR PROPOSALS, REQUEST FOR
QUALIFICATIONS AND ALL OTHER FORMS OF REQUEST FOR
PROCUREMENT FROM THE CITY OF MIAMI SHALL BE PREPARED BY A CITY
OF MIAMI EMPLOYEE AND IN THE EVENT THAT THE SAME IS NOT PREPARED
BY A CITY OF MIAMI EMPLOYEE, THE NON -CITY OF MIAMI EMPLOYEE
PREPARER SHALL BE BANNED FROM COMPETING FOR THE SAME
CONTRACT IN WHICH IT PREPARED THE REQUEST FOR PROCUREMENT.
WHEREAS, during the Miami City Commission meeting of July 10, 2007, Vice Chairman, Joe
Sanchez made an ore tenus motion which was second by Commissioner Marc David Sarnoff and
unanimously approved by the Miami City Commission, directing. the City Manager and City Attorney to
work together to create legislation that all bid documents, whether a Request for Proposal, Request for
Qualifications or any other form of procurement be prepared, in-house, by City of Miami employees
only and in the event that the form of procurement document is prepared by a non -City of Miami
employee, the non -City of Miami employee preparer shall be banned from competing for the very
same contract that it helped prepare; and
WHEREAS, the City Commission wishes to maintain credibility and integrity in the request for
procurement process;
NOW, THEREFORE, BE IT RESOLVED, BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is directed{1} to implement a policy requiring that all request for
letters of interest, request for proposals, request for qualifications and all other forms of request for
procurement from the City of Miami shall be prepared by a City of Miami employee and in the event
that the same is not prepared by a City of Miami employee, the non -City of Miami employee preparer
shall be banned from competing for the same contract in which it prepared the request for
procurement.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein direction is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto)by the City Commission.
