HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00281 Final Action Date: 5/24/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, APPROVING THE ATTACHED COCONUT GROVE RAPID TRANSIT ZONE DEVELOPMENT STANDARDS, LOCATED WEST OF SOUTHWEST 27TH AVENUE, EAST OF SOUTHWEST 29TH AVENUE AND BETWEEN SOUTHWEST 27TH TERRACE AND US1, MIAMI, FLORIDA, FOR CONSISTENCY WITH THE COCONUT GROVE RAPID TRANSIT ZONE DEVELOPMENT MASTER PLAN AND ADOPTION OF THE DEVELOPMENT STANDARDS, PURSUANT TO ARTICLE 4 OF ZONING ORDINANCE NO. 11000, AS AMENDED; DIRECTING TRANSMITTAL OF THE HEREIN RESOLUTION; MAKING FINDINGS OF FACT AND STATING CONCLUSIONS OF LAW; PROVIDING FOR BINDING EFFECT; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami -Dade County Rapid Transit Development Impact Committee after two public hearings recommended APPROVAL of the proposed Development Standards; and WHEREAS, the Planning and Zoning Department for the City of Miami is recommending APPROVAL of the proposed Development Standards; and WHEREAS, the Planning Advisory Board, at its meeting of March 7, 2007, Item No. 2, following an advertised hearing, adopted Resolution No. PAB-07-014, by a seven to zero (7-0) vote, recommending DENIAL {due to the lack of sufficient detail of: 1) Workforce housing; 2) Public participation; 3) Design Standards; 4) Affordable housing; 5) No maximum F.A.R.} of the Coconut Grove Rapid Transit Zone Development Standards as presented; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve these Development Standards as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The attached Development Standards are hereby approved for consistency with the adopted Station Area Design and Development Plan for the Coconut Grove Rapid Transit Zone, and the Master Plan Development Standards are hereby approved; Section 3. The Development Standards are in conformity with the adopted Miami Comprehensive Neighborhood Plan 1989-2000, as amended. b. The Development Standards are in accord with the applicable RT Zoning classification of Zoning Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. c. The City Commission further finds that: (1) the Development Standards have a favorable impact on the economy of the City; (2) the Development Standards will result in an efficient use of public transportation facilities; (3) the Development Standards proposed will favorably affect the need for people to find adequate housing, office, hotel and retail uses reasonably accessible to other locations within the City of Miami; (4) the Development Standards will result in an efficient use of necessary public utilities; (5) the Development Standards will not negatively impact the environment and natural resources of the City; (6) the Development Standards will not adversely affect conditions in the neighborhood; (7) the Development Standards will not adversely affect public safety; (8) based on the record presented and evidence presented, the public welfare will be served by the Development Standards. Section 4. The City Manager is hereby directed to instruct the Director of the Department of Planning to transmit a copy of this Resolution and attachments to the APPLICANT, c/o Gilberto Pastoriza, Esq., Weiss Serota Helfman Et Al, at 2525 Ponce De Leon Blvd., Suite 700, Coral Gables, Florida 33134-6045 and the appropriate Miami -Dade County officials including the Chair of the Miami -Dade Rapid County Transit Development Impact Committee. Section 5. This Resolution shall become effective thirty (30) days after its adoption. APPROVED AS TO FROM AND CORRECTNESS: JORGE L.
