HomeMy WebLinkAboutSubmittal AffidavitAFFIDAVIT STATE OF FLORIDA COUNTY OF MIAMI-DADE ) SUBMITTED INTO THE PUBLIC RECORD FOR ITEM Na g ON sio-02 , BEFORE ME, the undersigned authority, personally appeared Annette Mayer Diaz ("Affiant"), who by me being first duly sworn deposes and says on oath that: 1. Affiant is the full-time Executive Director of The Vizcayans, Inc. The Vizcayans' office is located at 3251 South Miami Avenue, Miami, Florida, within the East Gate Lodge at Vizcaya Museum and Gardens. The Vizcayans' phone number is (305) 856-4866; this number is listed in the publicly available listings in the City of Miami phone book and directory assistance. 2. Affiant, on Thursday, April 26, 2007, was physically present at the Miami City Hall located at 3500 Pan American Drive for the City Commission meeting scheduled to begin at 9:30 a.m. Affiant arrived at approximately 8:30 a.m. to ensure that Affiant would be able to enter the Commission chambers and find a seat for the vote of the City Commission on the 300 Grove Bay Residences Project. 3. When I arrived I saw a large number of people who filled the Commission chambers, the waiting area outside the chambers and the front of City Hall and were wearing yellow T-shirts. The yellow T-shirts had visible printed messages on the front and the back; the front said something like "Yes Grove Bay Residences" and the back said something like "Save Mercy". Because the Commission chambers were almost completely filled with persons wearing the yellow T-shirts, I, along with many other persons, was never able to find a seat and observe first hand the proceedings before the City Commission. While I was standing in the waiting area one of the persons wearing a yellow T-shirt, who appeared to be confused and restless, approached me and asked, "Why are we here?" 4. The next day, April 27, 2007, Affiant was at The Vizcayans' office when the phone rang at approximately 2:00 p.m. The call was from a man who called me "Miss Annette". The caller would not give me his name. The Vizcayans, Inc.'s telephone number has automatic caller ID, which showed on the telephone that the call was made from a telephone registered, as follows: Davis Lizzie MA 305- 444-9505. 5. The caller stated to me that he had brought people to the City Commission chambers at City Hall on April 26, 2007, and that the people he brought were wearing the yellow shirts. The caller said that each person wearing the yellow shirt was supposed to be paid $100, for wearing the yellow shirt at City Hall on O '7 - N 5 w��rf'` April 26, 2007. The caller indicated to me that he thought that Vizcaya would be paying the people who wore the yellow shirts. 6. I told the caller that the yellow shirts were in support of the Related Project at Mercy Hospital and the vote was in favor of Mercy 3 to 2. 7. Later in the afternoon of April 27, 2007, another call was received at The Vizcayans' office from a person who identified herself as a receptionist at Mercy Hospital. The automatic caller ID confirmed that the phone call was originated from Mercy Hospital. The caller said that she had a gentleman before her who stated that he was asking for "Annette" and was there to pick up his money for appearing at the hearing yesterday before the Miami City Commission. I informed the caller that The Vizcayans had made no promises or commitments for payment to any individual or group for appearing at the City Commission hearing and wearing a yellow T-shirt. She muffled the phone so that I could not hear, then came back to me and said, "Thank you, it is taken care of." Then she ended the call.
