AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS", BY MODIFYING THE
WIDTH OF NORTHWEST/NORTHEAST 79 STREET, BETWEEN BISCAYNE BAY
AND THE WEST CITY LIMITS, MIAMI, FLORIDA; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Florida Department of Transportation is currently finalizing the first phase of a
two-phase Project Development and Environment ("PD&E") study to evaluate alternatives and
preliminary design changes to Northwest/Northeast ("NW/NE") 79 Street and Northwest/Northeast
("NW/NE") 81 and 82 Street from Northwest 13 Court, Miami, Florida to Miami Beach, Florida; and
WHEREAS, the object of the study, strongly supported by the City of Miami ("City"), is to promote
livability enhancements along Northeast ("NE") 82 Street within the Shorecrest residential
neighborhood in the City while maintaining acceptable mobility standards along NW/NE 79 Street;
and
WHEREAS, the initial PD&E study has determined that the livability needs along NE 82 Street
cannot be adequately addressed without significant traffic capacity improvements to NW/NE 79
Street by way of roadway widening and/or transit improvements; and
WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City
Code"), establishes base building line locations for all public streets within the City; and
WHEREAS, to accommodate the traffic capacity improvements, an increase in the zoned width of
NW/NE 79 Street between Biscayne Bay and the west City limits from 80 feet to 110 feet is warranted
for the segment from Biscayne Bay and to NW 7 Avenue (this is a 30 foot increase, 15 feet from each
side of the roadway) and from 100 feet to 110 for the segment from NW 7 Avenue to west City limits
(this is a 10 foot increase, five feet from each side of the roadway; and
WHEREAS, the increase in zone base building line width is achieved through dedication as
properties redevelop along the corridor; and
WHEREAS, dedication of the rights -of -way will be included in the building permit review process
for new developments along NW/NE 79 Street;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by

reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and
Sidewalks/Base Building Lines/Nonstandard Street Widths," is amended in the following particulars:

Section 3. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective 30 days after final reading and adoption
thereof. {2}
