RE: Proposed Ordinance -March 8, 2007, City Commission Meeting
Amending Chapter 35, of the Code of the City of Miami, Florida, as
amended, entitled "Motor Vehicles," by amending Section 35-10, entitled
"Parking for Certain Purposes Prohibited." (File 07-00245)
The attached proposed Ordinance amends enforcement procedures prohibiting parking
for certain purposes.
Until April, 2003, Section 30-388.15 of the Miami -Dade County Code, which prohibits
parking for the same purposes as listed in subsection (a), was applicable county -wide, i.e., in
both the incorporated and unincorporated areas, and provided for enforcement by towing. In
April, 2003, the Miami -Dade County Commission amended Section 30-388.15 so that it now
applies solely within the unincorporated areas of the County, leaving it up to the municipalities
to enact similar parking regulations applicable in their jurisdictions. Section 35-10 of the Code
of the City of Miami, as amended, enacts parking enforcement provisions, including towing,
virtually identical to those contained in Section 30-388.15 of the Miami -Dade County Code.
