A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
REQUESTING THAT THE MIAMI-DADE COUNTY BOARD OF COUNTY
COMMISSIONERS SUPPORT AN AMENDMENT TO THE STATE CONSTITUTION
TO LIMIT THE AD VALOREM TAX ASSESSMENT ON REAL PROPERTY TO BE
ONE (1 %) PER CENT OF THE PROPERTY'S ASSESSED VALUE ,TO CAP
ANNUAL INCREASES IN ASSESSED VALUATION TO NO MORE THAT TWO (2%)
PER CENT FROM THE PRIOR YEAR'S VALUATION, AND TO REQUIRE THAT ANY
INCREASE IN ANY OTHER STATE TAX, FEE OR ASSESSMENT BE APPROVED
BY NO LESS THAN ATWO-THIRDS (2/3) VOTE OF EACH CHAMBER OF THE
LEGISLATURE; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE OFFICIALS DESIGNATED AS STATED HEREIN.
WHEREAS, the citizens of the State of Florida have experienced unprecedented increases in the
costs of building, owning and maintaining residential and commercial properties, due to unchecked
increases in insurance premiums and construction costs; and
WHEREAS, these continuously increasing tax assessments, insurance premiums and
construction costs have made it impossible for a great number of elderly individuals and families of
low and moderate income to own and maintain their homes and businesses; and
WHEREAS, although the current State Constitutional provisions limit increases in annual
assessments on homestead property to no more than three (3%) per cent of the assessment for the
prior year, there are no such provisions for any other form of ownership, nor are there provisions
relating to sales, transfers or inheritance of property, which involve tax considerations that can
effectively inhibit the free alienation of residential and non-residential property throughout the State;
and
WHEREAS, such measures as those addressed by the constitutional amendment advocated here
have been implemented in other states, including California and Massachusetts, and have not had
any negative impact on the total per capita revenues and expenditures realized after the
implementation of such limits; and
WHEREAS, the City Commission believes it to be in the best interest of the citizens of Miami,
Miami -Dade County and the State of Florida to have a constitutional safeguard against unchecked
and unaccountable governmental taxation which severely impacts the financial stability and security
of many of the least fortunate, and which will help preserve and secure the homesteads and equity of
property owners of property throughout the State;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission requests that the Miami -Dade County Board of County
Commissioners support an amendment to the State Constitution to limit the assessments on real
property and for other safeguards as expressed in the proposal in Exhibit "1," attached and
incorporated.
Section 3. The City Commission directs the City Clerk to transmit a copy of this Resolution to the
Miami -Dade County Mayor, Board of Commissioners, the Miami -Dade County Manager, the
Miami -Dade County Attorney and to all Miami -Dade County legislative representatives.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
