Subject: Amendment to Concession Agreement with Boston Culinary Group, Inc.
Purpose of Item:
A Resolution of the City Commission, authorizing the City Manager to execution an amendment to
the Concession Agreement between the City of Miami and Boston Culinary Group, Inc,, a Wisconsin
for- profit Corporation, dated August 16, 2003, to provide for a reduction of the percentage fee on
alcoholic beverage sales up to $2.6 million from 50% to 44% for a one year period commencing
August 16, 2006 and expiring August 15, 2007 while maintaining the minimum guarantee
requirements, and providing for the City's right to terminate the agreement for convenience upon
providing ninety (90) days prior written notice.

Subject: Amendment to Concession Agreement with Boston Culinary Group, Inc.
Background Information:
The City of Miami entered into a Concession Agreement with Boston Culinary Group, Inc. for the
operation of concession services at the Orange Bowl Stadium, RFP No. 02-03-136(080), as referenced
in Resolution No. 03-842, which agreement was for a 3 year term with the City's option to renew for two
additional periods of two years each. The City Manager has approved the first renewal of this contract
which will expire August 15, 2008. Ongoing capital renovations and repairs from last year's hurricane
season have impacted the number of events occurring at the Orange Bowl. The Concessionaire has
requested and the administration recommends that the percentage fee on alcoholic beverage sales up to
$2.6 million be reduced from 50% to 44% for a one-year period. Utilizing the sales of alcoholic
beverages over the last year as a basis, this would result in approximately $55,000 in less revenue to the
City. The Concessionaire has agreed that the minimum guarantee of $905,000 for the University of
Miami 2006 seven -game season shall remain applicable during this one-year period.
