HomeMy WebLinkAboutAnalysisANALYSIS FOR VARIANCES 2240 SW 12t AVENUE CASE NO: 2006-1080 Pursuant to Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for variance as follows: Variance for parking required: 8 Spaces proposed: 0 Spaces Request to waive: 8 Spaces The following findings have been made: • It is found the requested parking variance is for a new recreational building as part of the new Tennis Center within the existing Bryan Park. This expansion will facilitate to the community a better use of the new tennis courts along with the rest of the park. The required eight (8) parking spaces will take away precious green space currently being used by children and members of the community. In addition, the loss of park green space represents a hardship to the City, which justifies the requested variance.. • It is found that the proposed project offers the most reasonable solution to the design problem facing this particular site. • It is found that the proposed project is consistent with the City's urban infill objectives for this area of the city. • It is found that the proposed plans reflect the minimum amount of variance for the proposed use on that property; and further that the project as presented will have no adverse impacts on the area. The required additional eight (8) parking spaces could be accommodated within the existing perimeter of the park in the City's right -of way where there is currently more than sufficient on street parking to meet the needs of the park. Based on these findings, the Planning Department is recommending approval of the requested variance as presented. Literal interpretation of ordinance causes undue hardship on petitioner. Granting variance conveys same treatment to owner. Variance, if granted, is the minimum variance for reasonable use of property. Is in harmony with general intent and purpose of ordinance.
