Inc. on Project B-50654, Overtown Stormwater Pump Station Upgrades Purpose of Item: To authorize the City Manager to terminate the contract with One Crow, Inc. for default and to further authorize the City Manager to obtain pricing for completion of the work, hold One Crow, Inc. liable for the costs incurred in having the project completed, and proceed with action against One Crow, Inc.'s performance and payment bond. Background Information: The City Commission awarded a contract to One Crow, Inc. on May 27, 2004 for the Overtown Stormwater Pump Station Upgrades. The contract was subsequently executed in July 2004. The Department of Capital Improvements and Transportation (CIP) has made numerous efforts to have One Crow, Inc. comply with the requirements of the contract without success. One Crow, Inc. has failed to perform the work in a timely manner, and has not provided documentation required by the contract, including but not limited to current insurance certificates and an updated performance and payment bond. Based on One Crow, Inc.'s failure to comply, a stop work order was issued on October 11, 2005 until One Crow, Inc. came into full compliance with the contract. One Crow has failed to comply with the requirements of the stop work order and has not demonstrated any intent to comply. To expedite the completion of this project it is, therefore, necessary for the City to terminate the contract with One Crow, Inc. for default and contract with another contractor.
