HomeMy WebLinkAboutordinance (2)City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miaml.fl.us File Number: 05-00095 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "BICYCLES" TO PROVIDE DEFINITIONS AND REGULATIONS FOR THE PROHIBITION OF THE OPERATION OF BICYCLES, MOPEDS, MOTORIZED SCOOTERS, SCOOTERS AND OTHER SIMILAR DEVICES ON THE SIDEWALKS OF THE EASTERN SIDE OF BRICKELL AVENUE BETWEEN SOUTHEAST 4TH STREET AND SOUTHEAST 26TH ROAD, MIAMI, FLORIDA; MORE PARTICULARLY BY AMENDING SECTION 8-6; DIRECTING THE CITY MANAGER TO INITIATE A PUBLIC EDUCATION AND INFORMATION PROGRAM REGARDING THE APPLICABILITY OF SAID ORDINANCE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 8 of the Code of the City of Miami, Florida, as amended, is further amended to read in the following particulars:{1} "Chapter 8 BICYCLES, SKATEBOARDS, SCOOTERS AND OTHER SIMILAR DEVICES * Sec. 8-7 Prohibitions on the sidewalks of the eastern side of Brickell Avenue between Southeast 4th_ Street and Southeast 26th Road. To continue to encourage a pedestrian friendly environment and provide for the safety of pedestrians using the sidewalks, it shall be unlawful for any person to operate a bicycle, moped, motorized scooter, scooter, vehicle, or other similar devices, unless such devices are used to assist in transport of physically handicapped person, on the sidewalks of the eastern side of Brickell Avenue between Southeast 4th Street and Southeast 26th Road. Sec. 8-8. Signs. The director of public works is authorized to purchase and place the necessary signs required to prohibit bicycles, scooters and other similar devices as defined in this article on the sidewalks of the eastern side of Brickell Avenue between Southeast 4th Street and Southeast 26th Road Sec. 8 7 Sec. 8-9. Penalties for violation of this chapter. City of Miami Page 1 of 2 Printed On: 3/31a005 File Number: 05-00095 Every person guilty of a violation of any provisions of this chapter shall be punishable by a fine of not more than $25.00 *It Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance Is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. The City Manager is directed to initiate a public education and information program regarding the applicability of this Ordinance sixty (60) days prior to its effective date. Section 5. This Ordinance shall become effective ninety (90) days after final reading and adoption thereof. {2} APPTO FORM AND C ERNANDEZ RNEY CTNESS: Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
