HomeMy WebLinkAboutcover memotl CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : FROM : The Honorable Ma or and M ers of t ulissio Joe iola, Chi • dministrator/City Manager DATE: SUBJECT: SEP102004 FILE : Option to Purchase Real Property Located at 3188 SW 16th Terr. for a Fire Station in the Coral Way Area REFERENCES: Resolution and Option Agreement ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution, by an affirmative vote of 4/5ths of the members of the City Commission, authorizing the City Manager to exercise the Option to purchase the property located at 3188 SW 16th Terrace, Miami, Florida, (the Property), as legally described in the Option Agreement between the City of Miami and LPR Enterprises of Miami, Inc., a Florida Corporation (Seller), attached hereto and made a part hereof, in connection with the development of a fire station, with a purchase price of $1,408,000.00, and to consummate said transaction in accordance with the terms of said Option Agreement. This Resolution further allocates funds in the amount of $1,453,000.00 from the Neighborhood Fire Stations and Training Facility Project Account No. 313306.289307 appropriated from the $255 Million Homeland Defense/Neighborhood Improvement Bond to cover the cost of said acquisition inclusive of cost of survey, appraisals, environmental reports, title insurance and other closing costs associated with said acquisition. BACKGROUND: On December 12, 2002 the City of Miami Commission adopted Resolution No. 02-1294 which authorized and approved certain projects to be funded from the Homeland Defense/Neighborhood Improvement Bond Funds. On July 17, 2003 the City Commission adopted Ordinance No. 12380, as amended, the Capital Projects Appropriations Ordinance, to appropriate $15,750,000 available from the Homeland Defense/Neighborhood Improvement Bond Proceeds for various capital improvement purposes including appropriating $5,500,000 to the Neighborhood Fire Stations and Training Facility Project Account No. 313306. The Fire -Rescue Department has established that there is a need to add a fire station in the Coral Way area of the City in order to improve emergency response time. An independent appraisal was procured and established Two Hundred Twenty -Five Thousand Dollars ($1,225,000) as the fair market value for the Property. The Purchase Price exceeds the appraised value by 15%. It is a condition precedent to the validity of the Option Agreement and its execution by the City Manager that the City Commission of the City of Miami approve this Agreement by a greater majority of a 4/5th vote of its members, failing such approval the Agreement shall be automatically null and void without the necessity of further action by either party. FINANCIAL IMPACT: There is no impact to the City's General Fund.
