LOCAL 1907 SUBMITTED INTO THE PUBLIC RECORD FOR ITEM oi ON q-9-09. At the last City Commission meeting a lot of questions were asked about our pension. I want to make certain that your questions are answered and that they are answered in a truthful way. A lot of statements were made about the City employees' pay; about the pay in private industry and about the way things work in the City. A number of statements have been made to the press about how the City employees are simply a drain on the City and that the City can't meet its obligations because of the high cost of the pension. I want to clarify the many misstatements which have been made. As you make decisions, we want you to have all the information and we want you to be basing your decisions on facts. I intend to be a one -person truth squad, so that each of you, the City administration, and most importantly, the taxpayers of the City of Miami will know the truth. With all due respect to each and every elected official and high ranking appointed officials let me say that the City of Miami was here before you came and the City of Miami will be here once you leave. You have each earned the right to represent the taxpayers of the City of Miami for a certain period of time and we don't argue that. We only state that the people of the City of Miami, wanted to make certain that there is a Submitted Into the public record in connection with item �y. on 1 Priscil;a A. Thompson City Clerk professional workforce that is not beholden to any politicians which may come and go, but is beholden only to the City and its people. First, it's been said that the City's pensions are just a drain on the City, and may cause the City to go bankrupt. TRUTH: If the City goes bankrupt, it will be because of the mismanagement of this administration and prior administrations, and the decision making by commission after commission. For example, 19 executives were forced out by the present administration, and these people retired way before they had planned to. This caused quite a spike in the pension costs for this year and going forward. Now let's talk about our pension. Commissioner Winton, we do not have a twenty and out pension like you explained it. USE CHART #1. For years, the City misrepresented to the taxpayers what it was doing with its tax revenues. The City raised money from its taxpayers for pension purposes, but did not give it to the pension. In other words, the City stole from its taxpayers and the employees and their pension. This is not just me talking. This is what the Third District Court of Appeals said in Gates. "The City's claim amounts to the suggestion that, while one may not rob Peter to pay Paul, it is permissible to take from Paul himself in order Submitted into tr,e publlfc record in connect .n vitb 2 item 1)(1. The City agreed to settle the Gates case and in doing so, agreed to make the pension solvent by promising to put in a certain amount of money each year. Now that should not seem like a surprising proposition, but it was something new in the City. Another thing the City agreed to do was to give up direct control of the pension. The employees started having a say in how the money was invested, and the results have been terrific. We stopped earning the one percent return that was averaged when the City ran the pension. And we have saved the City millions of dollars. We have run the pension like a business without showing favoritism to any person, but getting the best companies to advise us and to invest our money. We have done so well, the pension grew by so much, that in 1997 the City came to the retirees and the unions and asked that the Gates settlement be changed so that they would not have to pay in as much money. We agreed to let the City and the taxpayers forget the debt. We received an increase in our COLA from 2% per year to 4% per year, to a maximum of $400.00 per year. In exchange, the City did not have to make the payments which it itself had agreed to pay. If the unions and retirees had not forgiven this debt, the City would have had to pay $ 156.8 million in unfunded liability alone. Since 1997, the City has only paid $38.7 million Submitted into the public record in connection ith 3 item ztf.I on o4 Priscilla A. Thompson City Clerk dollars in unfunded liability. In the six years prior to when we agreed to the City's request to resettle Gates, the City paid $70.5 million dollars in unfunded liability, which was Tess than Gates required due to great returns and the cooperation from the Unions and retirees. In 11 of the last 15 years, the employees have paid in total contributions more than the City has. In 1997, when the City was not required to put in any money, instead of putting in one, two or three million dollars, sort of like a rainy -day fund, the City decided not to put in anything. Instead of saving for a rainy day, the City just waited for it to rain and now it's raining and the City is crying that it doesn't have an umbrella. Commissioner Sanchez, I listened carefully to your remarks of the last commission meeting and you said that we all need to work together. What you must understand is that there is a long history of the unions working with the City. The Gates settlement is just an example. In exchange for modest increases in our COLA, we agreed to drastically reduce the payments you would have had to make in the years since 1997. We have had phenomenal returns from the pension fund. Now, when the market is down, Commissioner Winton says that we have to look carefully at the COLA. So, as I understand the City's concept of working together, it goes like this. We agreed, and received a modest increase in our COLA. Then you come to us and say that we have to give up our COLA. So working together is that you give the employees something, the employees give you something and then you take back what you gave the employees. Now you may think that we're all just peon city workers, but I assure you, we are not stupid. We are public servants, who take our responsibilities to the taxpayers very seriously, and like I said earlier, after you're gone, we will still be here. And so will the stock market. Markets go up and markets go down. You need to take the long view, and believe in the American economy. Commissioner Winton spoke about the five percent step increases in the first five years that union members get, and said they are not given in the private sector. We know the Mayor and Manager say that they are trying to run the City like a private business, and the Manager even refers to himself as a chief executive officer. Let's look then at what the union members get and let's look at what is paid to those high ranking executives that the manager brings in from private industry, so that the City can be run like private industry. 5 Submitted Into the public record in connection with item b .1 on Prisiiia A. Thompson City Clerk Let's talk about the union members first. It is true that we get step raises. Not every year as Commissioner Winton said but we get them at years 2 through 5, 10, 15, 16, 20, 21 and a 2 '/2 step increase after 22 years. USE CHART #2 That's right, the City has a pay plan and it takes us 22 years to reach the top. We start low and are given raises if we perform in a satisfactory manner. That is how every government agency works: federal, state, county, and other cities. The pay plan for the executives who come to us for private industry also have a pay plan that calls for step increases. Under their pay plan, it should take them 10 years to reach the top, but it doesn't. Why? Because they come in at the highest salary. That's right, it does not take them 22 years to reach the top of the pay plan, they reach it right away, because that's where the manager starts them. Let me give you an example. Use Chart #3 & #4 If Commissioner Winton thinks that we should not get yearly increases, then just start us at the top of the pay plan like you start the executives. This City has a pay plan for executives, but it doesn't follow it. Thompson City Clerk According to this City, that means that we should come in low and stay there and that the executives should come in high and go higher. Now I understand when the manager says he wants to run the City like a business. I am not here to run down business. Business does much that is right in this country and we celebrate the market economy. We celebrate the bounty that labor and capital working together has brought us all. But business is not perfect, and it has done much that is wrong. And we know of some of these things because we read about it all the time. Enron, World Com, Global Crossing, Halliburton. Just because you say you want to run it like a business does not mean that you are immune from criticism and that you do not have to be completely forthcoming with the public. In order to get to Step 22, a city worker has to have a proven track record of satisfactory performance. Not so with people who are hired by the Manager because when its his people, he just throws the pay plan away and gives the taxpayers money away. They just come in at the highest level, and it doesn't matter how they produce. They can only go up. USE CHART #3 & #4 But maybe there are people so good, so experienced and with so much insight into the position that they should receive the highest pay. Thompson City Clerk USE CHART #5 Well let's take a look at some of the people who are coming in from private industry at pay that is off the charts. There is Ricardo Gonzalez, who is now the head of NET. He is making $104,742 and should be making, according to the pay plan, $82,160. Let's see what special insight he brought to his position. Mr. Gonzalez worked for the Traveler's Property Casualty Insurance Company, for 27 years and retired before he came here. He supervised the handling of property casualty claims. Let's look at what other skills he may have had. He was once a high school teacher and basketball coach. Then of course there is Mariano Loret De Mola who has been placed in charge of the Code Enforcement. He should be making $70,946, but is making $104,040. Well what is Mr. Loret De Mola's background that shows that he should be paid at the highest rate of pay? He was involved in the Meat and Chicken Inspection Program for the United States Department of Agriculture. I'm sure that he learned a lot about the City Code there. Let's look, while we're discussing Net, how this Administration has destroyed NET. Net was one the bright lights, the shining star of City government. In one place, a citizen could fill out police reports, take care of zoning and building code compliance issues, get information about how Submitted Into the public record in connection with item p N. I on q 8 Priscilla A. Thompson City Clerk City government worked. The NET service centers were mini City Halls. Now, Code Enforcement is a separate division and police reports are not taken at NET. Now, Homer Whitaker, the administrator of two NET offices in Coconut Grove, was told that he could not even speak to Code Enforcement Inspectors in Coconut Grove to determine the status of a permit. The proof is in your handout. We don't even let City employees talk to each other to get the information needed to do their jobs. Maybe this is some sort of special business management tool, but I think the taxpayers want their public servants passing on important information to each other. Now, who wrote this memo prohibiting Net Administrators from talking to Code Enforcement Officers. (rain Gonzalez, Chief of Operations. He just turned 25, so we know his experience is limited. Just four years ago, he was an Intern for Dade County Department of Corrections, making $10.00 per hour. He started here in the City as a special aide to the Mayor at $25,000 per year. He is now making $67,887.25. He even wrote a memo about an employee meeting he was attending, and said that he would be taking attendance, just like in High School. Well, he has not been out of high school that long, maybe that explains it. 9 Submitted Into the public record in connection ith item Jx4.1 on e4 Priscilla A. Tho pson City Clerk Then of course there is an Administrative Assistant I who wrote on her application that she had graduated from Florida State University. This was not a truthful statement. No problem. The manager didn't care that she made a misrepresentation on her application. He fixed the whole problem and gave her one year to complete her graduation. Three people have been fired from the City for lying on their application. One employee had 14 years with the City and another employee that had 6 months service was terminated. Under this Administration, 1 employee has been fired for lying on their application, a firefighter. Now, Mr. Arriola tells us that it is okay for some people to make false statements on their application, don't worry about it, he'll give you time to make it true. While I'm not a businessman, and I don't know if this is how business runs, but I will tell you a simple truth: This is the wrong way to use taxpayers' money. I want to make this very clear. This is not the end of the truth telling. I will not stand by while the administration gives inaccurate and misleading information to the elected official and taxpayers.
