HomeMy WebLinkAboutdraftn J DRAFT A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO STRICTLY AND CONSISTENTLY ENFORCE THE CITY OF MIAMI CODE AND ZONING ORDINANCE, MOST SPECIFICALLY, ARTICLE 4/SECTION 401 OF ZONING ORDINANCE NO. 11000, AS AMENDED, ENTITLED "ZONING DISTRICT/SCHEDULE OF DISTRICT REGULATIONS" RELATED TO THE ENFORCEMENT OF MORE THAN ONE AND MULTIPLE ILLEGAL/UNPERMITTED DWELLING UNITS CONSTRUCTED ON RESIDENTIAL PROPERTY; FURTHER DIRECTING THE CITY MANAGER TO FOCUS THE RESOURCES OF THE OFFICE OF CODE ENFORCEMENT ON THESE MULTIPLE ILLEGAL/UNPERMITTED DWELLING UNITS AND LIMITING THE RESOURCES RELATED TO ENFORCEMENT OF SINGLE ILLEGAL/UNPERMITTED DWELLING UNITS ON RESIDENTIAL PROPERTIES FORA PERIOD OF 18 MONTHS. • WHEREAS, the City of Miami ("City") is overwhelmed by an exorbitant amount of multiple illegal/unpermitted dwelling units throughout its communities; and WHEREAS, the City's Office of Code Enforcement is overburdened with a plethora of cases and a fixed amount of resources and revenue for the task of enforcing the City Code and Ordinances; and WHEREAS, the City would greatly benefit from safety, economic, and aesthetic perspectives if the_Office'of Code Enforcement would focus its resources mainly on enforcement of the problem of multiple illegal/unpermitted dwelling units within the City; BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is directed to strictly and consistently enforce the City of Miami Code and Zoning Ordinance, most specifically, Article 4/Section 401 of Zoning Ordinance No. 11000, as amended, entitled "Zoning District/Schedule of District Regulations" related to the enforcement of more than one and multiple illegal/unpermitted dwelling units constructed on residential property. Section 3. The City Manager is further directed to focus the resources of the Office of Code Enforcement on these multiple illegal/unpermitted dwelling units, thus limiting the resources related to enforcement of single illegal/unpermitted dwelling units on residential properties for a period of 18 months. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} • APPROVED AS TO FORM AND CORRECTNESS: MARIA J. CHIARO, INTERIM CITY ATTORNEY {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
