HomeMy WebLinkAboutOrdinanceCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00818 Final Action Date: 7/22/2004 AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING SECTION 7 OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ELECTION OF CITY COMMISSIONERS AND MAYOR," CHANGING THE DATE OF THE RUNOFF ELECTION FOR MAYOR AND CITY COMMISSIONERS FROM THE SECOND TUESDAY TO THE THIRD TUESDAY IN NOVEMBER OF ODD -NUMBERED YEARS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statute 100.3605 "Conduct of municipal elections" provides, in part, that the governing body of municipality may, by ordinance, change the dates for qualifying and for the election of members of the governing body of the municipality and provide for the orderly transition of office resulting from such date changes; and WHEREAS, Florida Statute 166.021(4) provides that among the various municipal home rule powers is the ability to amend a municipal charter for selection of election dates; and WHEREAS, it is necessary, and in the City's best interest, to change the time of the runoff election from the second Tuesday in November of odd -numbered years to the third Tuesday in November of odd -numbered years; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 7 of the Charter and Related Laws of the City of Miami, Florida, as amended, entitled "Election of city commissioners and mayor," is amended in the following particulars:{1} "PART 1 CHARTER AND RELATED LAWS Subpart A THE CHARTER Sec. 7. Election of city commissioners and mayor. A runoff election for the mayor and city commissioners shall be held on the cccond third Tuesday after the first Monday in November in odd -numbered years. All elections held in sa+4 the city shall be conducted and held according to the provisions of the general election laws of the State of Florida, except as otherwise provided for in the Charter. *II Section 3. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{2} APPROVED AS TO FORM AND CORRECTNESS: MARIA J. CHIARO INTERIM CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
