HomeMy WebLinkAboutexhibit-unity of titleUnity of Title WHEREAS, the undersigned is the owner of that property described as: Parcel A Parcel B also known as Miami, Florida, and The undersigned recognizes and acknowledges that for the public health, welfare, safety or morals, the herein -described property should not be divided into separate parcels owned by several owners so long as the same is put to the hereinafter use, and In consideration of the issuance of a permit and for other good and valuable considerations, the undersigned hereby agrees to restrict the use of the subject property in the following manner: 1. That said property shall be considered as one plot and parcel of land and that no portion of said plot and parcel of land shall be sold, transferred, or devised separately, except in its entirety as one plot or parcel of land; provided, however, that this provision shall not restrict the leasing and/or sub -leasing of portions of the property to separate entities nor the transfer of such leasehold and/or sub -leasehold estate nor shall it restrict the granting of separate mortgages, or other similar encumbrances on such leasehold and/or sub -leasehold estates. 2. The undersigned further agrees that this condition, restriction and limitation shall be deemed a covenant running with the land, shall be recorded in the Public Records of Miami - Dade County, and shall remain in full force and effect and be binding upon the undersigned, their heirs and assigned until such time as the same may be released in writing by the Director of Building and Zoning Department or his/her designated representative; Provided, however, that this Unity of Title may be released by the Director of Building and Zoning Department of his/her designated representative, after approval of a site plan which meets all applicable City regulations.
