Mr. Joseph H. Ganguzza offered the following resolution and moved its adoption
Resolution:
AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1305 OF ORDINANCE NO.
11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF
THE SPECIAL EXCEPTIONS REQUIRING CITY COMMISSION APPROVAL AS PART OF A
MAJOR USE SPECIAL PERMIT FOR THE ISLAND GARDENS AT WATSON ISLAND
PROJECT, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE
OF THE CITY OF MIAMI, SECTION 915.2, FOR FAA CLEARANCE LETTER; ARTICLE 9,
SECTION 917.1.2, TO ALLOW RESTAURANT PARKING FACILITIES MAINTAINED WITH
VALET PARKING UP TO FIFTY PERCENT OF REQUIRED OFFSTREET PARKING SPACES;
ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW RETAIL
SPECIALTY SHOPS INCLUDING RETAIL SALES OF BOATING, FISHING, DIVING AND
SWIMMING SUPPLIES AND EQUIPMENT WITHIN EXISTING WATERFRONT SPECIALTY
CENTERS WITHIN EXISTING PARKS, WITH OUTSIDE DISPLAY AND SALES OF BOATS
ONLY BY SPECIAL EXCEPTION APPROVED BY THE CITY COMMISSION; ARTICLE 4,
SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW BOAT RENTALS AND
CHARTERS; ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO
ALLOW MARINAS, AND ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT
REGULATIONS, TO ALLOW A FISH MARKET AND RESTAURANT WITH 7,800 SQUARE
FEET WITH CITY COMMISSION APPROVAL FOR THE PROPERTY LOCATED AT
APPROXIMATELY 1050 MACARTHUR CAUSEWAY, LEGALLY DESCRIBED AS EXHIBIT "A"
(HEREBY ATTACHED), PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED C-1
RESTRICTED COMMERCIAL AND PR PARKS AND RECREATION. THESE SPECIAL
EXCEPTIONS WERE RECOMMENDED APPROVAL TO THE CITY COMMISSION PER PLANS
ON FILE WITH A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING
PERMIT MUST BE OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS BY THE
PLANNING AND ZONING DEPARTMENT: 1) THE APPROVAL OF THIS MAJOR USE
SPECIAL PERMIT SHALL BE SUBJECT TO THE RECORDATION OF THE DEVELOPMENT
ORDER SPECIFYING THAT THE DEVELOPMENT ORDER RUNS WITH THE LAND AND IS
BINDING ON THE APPLICANT, ITS SUCCESSORS AND ASSIGNS, JOINT OR SEVERALLY,
2) THE LESSEE, FLAGSTONE ISLAND GARDENS, LLC, SHALL COMPLY WITH THE LEASE
AND DEVELOPMENT AGREEMENT WITH THE CITY OF MIAMI, 3) PURSUANT TO THE
REQUIREMENTS OF MIAMI-DADE COUNTY, THE PROPOSED PROJECT SHALL REQUIRE
THE REVIEW AND APPROVAL OF THE SHORELINE DEVELOPMENT REVIEW COMMITTEE
PRIOR TO THE ISSUANCE OF A BUILDING PERMIT FOR THE PROJECT AND 4) THIS
APPROVAL SHALL ALSO BE SUBJECT TO ALL ADDITIONAL CONDITIONS AS SPECIFIED
IN THE FINAL DEVELOPMENT ORDER FOR THE PROJECT.
